Case against Ekrem İmamoğlu dismissed

The lawsuit filed against Istanbul Metropolitan Municipality Mayor Ekrem İmamoğlu on the grounds of insulting public prosecutors has been dismissed by the Istanbul Criminal Court of First Instance. The court terminated the case, stating that the defendant's offense falls under the scope of preliminary payment in accordance with Article 75 of the Turkish Penal Code (TCK).

DECISION TO DISMISS THE CASE

In the court's ruling, it was stated that the case against Ekrem İmamoğlu was filed for the crime of “publicly insulting a public official due to their duty.” However, as a result of the examination, it was determined that the crime charged against the defendant falls under the scope of preliminary payment pursuant to Article 75 of the TCK. The court issued a warning to İmamoğlu to pay the specified preliminary payment amount within the given timeframe. In accordance with the documents showing that İmamoğlu deposited the specified amount into the treasury office, it was decided to dismiss the case due to the preliminary payment.

TRIAL EXPENSES LEFT TO THE PUBLIC

The court issued its decision regarding the dismissal of the case in the absence of the parties, and the hearing record was prepared to be served to the parties. Furthermore, it was decided that the trial expenses would be left to the public. The right to appeal the decision was granted, and the path to the appellate court was kept open. It was stated that the parties could apply to the court with a written petition within two weeks from the notification of the decision. If no appeal is filed, the decision will become final.

APPEAL PATH OPEN

In line with the decision rendered by the court, the case was dismissed with the participation of the Public Prosecutor and contrary to the prosecutor's opinion. It was also noted that the decision could be taken to the Istanbul Regional Court of Justice for appeal.
