CHP's Emir: 'The Constitutional Court occasionally makes fair decisions'

CHP Ankara Deputy Murat Emir made statements during his speech at the budget negotiations in the Grand National Assembly of Turkey (TBMM).

Stating that while the Court of Cassation and the Council of State generally tend to be subservient, the Constitutional Court occasionally makes fair decisions, Murat Emir noted, "We see traces of the rule of law from time to time in the decisions of the Constitutional Court. This situation stems from the Constitutional Court's relationship with the Council of Europe, the European Court of Human Rights, and the Venice Commission. The Constitutional Court, which respects international legal principles, occasionally reflects fragments of the rule of law in its decisions."

Expressing that he must state with regret that the Constitutional Court is not a court famous for its justice, protecting the constitution, or defending fundamental rights and freedoms, Emir said, "In its essence, it is a court that is appointed by the palace and pays attention to the palace in almost all of its decisions. Unfortunately, Turkey is a state without a constitution; it has been knowingly and intentionally de-constitutionalized. The Court of Cassation and the Council of State have been subservient, but the Constitutional Court occasionally makes fair decisions because the Constitutional Court is in a relationship with the Council of Europe, the ECHR, and the Venice Commission."

Furthermore, the Deputy stated, "It cannot easily trample on universal legal principles. That is what the powerful in the palace call 'unpatriotic' judiciary. According to them, the Court of Cassation is patriotic because it is completely under control, but the Constitutional Court is 'unpatriotic' because it occasionally issues rulings on rights violations that the palace does not want."
