CHP files annulment lawsuit against TSK Personnel Law

CHP files annulment lawsuit against TSK Personnel Law

The Republican People's Party (CHP) has filed a lawsuit with the Constitutional Court to stay the execution and annul the Law on Amendments to the Turkish Armed Forces (TSK) Personnel Law and Certain Other Laws. 

CHP Group Deputy Chairman Gökhan Günaydın, in his statement regarding the lawsuit, stated that many provisions of the law are contrary to the law and listed the grounds for annulment.

LEADS TO POLITICIZATION

Claiming that the law leads to the politicization of the Turkish Armed Forces, Günaydın said, "The transfer of the authority to promote highly successful captains and majors, as well as highly successful senior master sergeants and sergeant majors, to a higher rank from the force commanders to the Minister of National Defense and the Minister of Interior causes the politicization of the Turkish Armed Forces."

He also emphasized that practices such as the obligation for military students and personnel to repay two to four times the expenses incurred on them if they leave the military system, and the determination of the procedures and principles for interviews for those to be appointed to inspector positions by regulation, are also contrary to the law.

Other regulations, such as the restriction of the right to education and the regulation of the personal rights of expert sergeants and contract sergeants and privates by regulation, were also criticized.

Gökhan Günaydın stated that the grounds for the lawsuit should be examined in detail and that the compliance of these regulations with the law will be evaluated by the Constitutional Court.
