CHP files application to Constitutional Court for HSK election! 'It should be annulled'

The CHP has applied to the Constitutional Court with a request for the annulment and stay of execution of the HSK elections held in the TBMM.

WHAT HAPPENED YESTERDAY?

Yesterday, an election was held in Parliament to determine 5 members of the Council of Judges and Prosecutors (HSK), and a procedural debate broke out during the voting in the TBMM General Assembly.

The CHP found the decision to hold a re-vote instead of drawing lots in the joint committee to be unconstitutional and abruptly left the General Assembly. CHP Group Deputy Chairman Gökhan Günaydın also made a statement regarding the issue and said, "We will take this illegality to the Constitutional Court." Today, CHP officials officially filed the application with the Constitutional Court (AYM).

In the election, Fuzuli Aydoğdu, Hakan Yüksel, and Seyfi Han were elected to the HSK from among the members of the Court of Cassation, while Cengiz Aydemir was elected from among the members of the Council of State. Alişan Tiryaki received the most votes from the list of faculty members and lawyers.

WHAT HAPPENED?

The 15 candidates to be elected to replace the 5 members of the Council of Judges and Prosecutors (HSK) whose terms were set to expire came to the General Assembly agenda after being selected by the TBMM Constitutional and Justice Joint Committee. Members of Parliament elected three people from the Court of Cassation quota, one from the Council of State quota, and one from the lawyer and higher education faculty member quota.

In the first round of voting, since the two-thirds majority of the total number of members was not reached by any candidate, the second round was held. In the second round, the votes of 360 deputies, which is the three-fifths majority of the total number of members, were sought.

Since the conditions were not met for any candidate in the second round, the third round was held. In the third round, lots were drawn between the two candidates who received the most votes.

Accordingly, Fuzuli Aydoğdu, Hakan Yüksel, Seyfi Han, Cengiz Aydemir, and Alişan Tiryaki were elected as members of the HSK. The elected HSK members will serve for 4 years.

CHP MEMBERS LEFT THE GENERAL ASSEMBLY

A procedural debate took place during the election of the members. The CHP left the General Assembly, finding it unconstitutional to hold a re-vote instead of drawing lots in the joint committee. CHP Group Deputy Chairman Gökhan Günaydın stated that the election was unlawful. Günaydın argued that the government violated the Constitution. The CHP Group left the General Assembly after Günaydın's speech.

APPLICATION FILED TO THE CONSTITUTIONAL COURT

CHP Group Deputy Chairman Gökhan Günaydın had used the expressions, "We will take this illegality to the Constitutional Court."
