CHP's Günaydın issues press statement regarding Court of Cassation ruling

CHP Group Deputy Chairman Gökhan Günaydın stated that the 3rd Criminal Chamber of the Court of Cassation has effectively declared the Constitutional Court 'unpatriotic' with its decision on Can Atalay.

CHP's Günaydın issues press statement regarding Court of Cassation ruling

CHP Group Deputy Chairman Günaydın, at a press conference he held in Parliament, evaluated the decision of the 3rd Criminal Chamber of the Court of Cassation not to comply with the Constitutional Court's (AYM) ruling of rights violation regarding Can Atalay, a defendant in the Gezi Park trial who was elected as a deputy from the Workers' Party of Turkey (TİP), as well as its decision to file a criminal complaint against the members of the Constitutional Court.

''THEY ARE DECLARING THE CONSTITUTIONAL COURT UNPATRIOTIC''

Arguing that what has transpired is an example of the instrumentalization of law and the politicization of the judiciary, Günaydın stated that the issue has long since "surpassed the Can Atalay dimension." Günaydın made the following assessments:

"The Constitutional Court did not only issue a violation ruling because Can Atalay could not exercise his political rights; alongside that, it also issued a ruling on the violation of personal security by drawing attention to the issue of a fair trial regarding personal security. The Court of Cassation, by not implementing this, is not only taking a stance against Can Atalay or the Gezi trial, but is effectively declaring the Constitutional Court unpatriotic. Investigations must be launched immediately against the Court of Cassation members who issued this decision through the Court of Cassation's First Presidency Board, and the necessary sanctions must be applied."

Günaydın stated that the protest action by CHP deputies in the Grand National Assembly of Turkey (TBMM) to not vacate the General Assembly will begin today and will continue.
