CHP's Deniz Yücel reacts to Yılmaz Tunç on the Constitution: 'Who was it that tied the judiciary to the executive?'

CHP Spokesperson Deniz Yücel reacted to a post by Minister of Justice Yılmaz Tunç, in which he cited Article 138 of the Constitution. Yücel stated, 'Who was it that bypassed the Grand National Assembly of Turkey (TBMM) and tied the judiciary to the executive through the constitutional referendum held under state of emergency conditions in this country?'

CHP Spokesperson Deniz Yücel,  reacted to a post by Minister of Justice Yılmaz Tunç, in which he cited Article 138 of the Constitution, which regulates the independence of judges.  

Yücel, 'Who was it in this country that,  through the constitutional referendum held under state of emergency conditions, bypassed the TBMM and tied the judiciary to the executive?' he asked. 

In a statement made on social media, Deniz Yücel used the following expressions: 

'AKP's Minister of Justice Yılmaz Tunç, who does not comply with the Constitution and does not implement Constitutional Court rulings, has made a post citing Article 138 of the Constitution, which regulates the independence of judges....

Mr. Tunç, let us remind you if you have forgotten:

Who was it that, under state of emergency conditions in this country,  bypassed the TBMM and tied the judiciary to the executive through a constitutional referendum?

Who was it that reassigned members of the judiciary who made rulings that were lawful but bothered the AKP?

Who was it that shouted at the top of their lungs, 'I am the prosecutor of Ergenekon,' and allocated an armored vehicle to FETÖ hitman Zekeriya Öz?

Who was it that made the heads of high judicial bodies scramble to find buttons to fasten their robes in front of the President?

The Minister of Justice of the AKP, which is the very cause of all the lawlessness we would not see in any democratic country,  @yilmaztunc! Believe me, no legal professional would want to be in your shoes!''


WHAT IS ARTICLE 138 OF THE CONSTITUTION? 

Article 138 of the Constitution numbered 2709 is as follows: 

Article 138- Judges are independent in the discharge of their duties; they shall give judgment in accordance with the Constitution, law and

they shall deliver judgments in accordance with the law and their conscientious convictions.

No organ, office, authority, or person may, in the exercise of judicial power,

give orders or instructions to courts and judges; send circulars; or make recommendations or

suggestions.

No questions may be asked, debates held, or statements made in the Legislative Assembly

regarding the exercise of judicial power in a case currently being heard.

The legislative and executive organs and the administration are obliged to comply with court decisions;

these bodies and the administration cannot change court decisions under any circumstances, nor can they delay their

implementation.
