Constitutional Court ruled 'rights violation': Local court adjourns without discussing Can Atalay decision!
The General Assembly of the Constitutional Court sent the summary of its violation ruling regarding the individual application of Can Atalay, a defendant in the Gezi Park case who was elected as a deputy from the Workers' Party of Turkey (TİP), to the Istanbul 13th High Criminal Court. However, the court panel adjourned without discussing the decision.
The General Assembly of the Constitutional Court concluded that the rights to "be elected and engage in political activity" and "personal liberty and security" of Can Atalay, who was elected as a deputy for Hatay, were violated in his individual application.
The short decision of the Constitutional Court General Assembly was sent to the Istanbul 13th High Criminal Court for the elimination of the rights violations.
COMPENSATION DECISION RENDERED
The short decision stated that it was ruled for a copy of the decision to be sent to the Istanbul 13th High Criminal Court for the "fulfillment of procedures such as initiating the retrial of the applicant, suspending the execution of the conviction, ensuring his release from the penal institution, and issuing a stay of proceedings in the retrial."
The Constitutional Court's short decision also reported that it was decided to pay Atalay 50 thousand Turkish Lira in non-pecuniary damages due to the rights violation.
PANEL LEFT THE COURT
All eyes were on the local court in the case where legal experts were expecting a release decision, but expectations remained unfulfilled. The court panel adjourned without discussing the decision.
