'Court of Cassation' debate in the Grand National Assembly of Turkey

While the Court of Cassation 3rd Criminal Chamber's filing of a criminal complaint against Constitutional Court members in the Can Atalay case remains a hot topic, a polemic occurred in the Grand National Assembly of Turkey (TBMM) between Workers' Party of Turkey (TİP) MP Sera Kadıgil and AKP Group Deputy Chair and Ankara MP Leyla Şahin Usta.

"A CRISIS HAS BEEN CREATED TO DRAFT A NEW CONSTITUTION"

TİP MP Kadıgil stated, "Lies are being told constantly. A crisis has been created to draft a new constitution," adding, "There is a Court of Cassation that does not comply with an article of the Constitution. If you cannot name this, you cannot call yourselves members of parliament, and you have no right to sit in these seats because if there is no Constitution, there is no member of parliament, there is no President, there is no minister! If there is no Constitution, there is no longer a legitimate state!"

"WE NEVER ACCEPT SUCH AN ACCUSATION"

Kadıgil's remarks drew reactions from the AK Party benches. AKP Group Deputy Chair Usta said, "We never accept such an accusation. A member of parliament has no right to call another member of parliament a liar, neither from the podium nor from where they are sitting. Calling someone a liar does not suit a member of parliament at all. We know that people who accept their own truths call others liars. I suppose the honorable member has such a problem as well."

"YOU HAVE NO RIGHT TO CALL ANYONE A LIAR"

Asking the question, "Why is there so much fear and hesitation about drafting a constitution?" Usta said, "I do not understand this. Ms. Sera does not have a will that is superior to the will of this nation. You have no right to call anyone a liar."

WHAT HAPPENED?

The Court of Cassation 3rd Criminal Chamber had filed a criminal complaint against the members of the Constitutional Court who ruled that there was a violation of rights regarding Can Atalay, who was elected as an MP from TİP after being arrested in the Gezi Park trial, and who decided that he should be released. Stating that the Constitutional Court had exceeded its authority by violating the Constitution and that the High Court's decision should not be complied with, the Court of Cassation had also notified the TBMM for the revocation of Can Atalay's parliamentary membership.
