MHP's Öcalan formula revealed: 'Without the need for an amnesty...'

It has been alleged that the Nationalist Movement Party (MHP) has pointed to a legal framework under which the leader of the terrorist organization PKK, Abdullah Öcalan, could be removed from İmralı and placed under house arrest without the need for an amnesty.

According to a report by Alican Uludağ, Article 16 of the Law on the Execution of Sentences and Security Measures No. 5275, titled "Postponement of the execution of a prison sentence due to illness," allows for the temporary postponement of the execution of sentences for prisoners whose health condition is critical.

DIAGNOSIS OF ILLNESS IS DETERMINED BY A FORENSIC MEDICINE REPORT

According to the law, for the sentences of ill prisoners to be postponed, it must be documented by a report from the Council of Forensic Medicine that their health condition "poses a life-threatening risk."

This report is prepared by the health boards of fully equipped hospitals and becomes valid upon approval by the Council of Forensic Medicine. Subsequently, the Chief Public Prosecutor's Office in the jurisdiction where the sentence is being executed may decide to postpone the sentence.

It is stated that if such a decision is made for Abdullah Öcalan, the authority that would manage the process is the Gemlik Chief Public Prosecutor's Office, to which İmralı Island is attached.

It was stated that the Chief Public Prosecutor's Office could decide to postpone the execution of the sentence after reviewing the Forensic Medicine reports.

HOW WILL THE LEGAL PROCESS WORK?

Under the law, the prisoner or their legal representative decides where the prisoner will stay if the execution of the sentence is postponed.

If such a decision is issued for Abdullah Öcalan, his address of residence will also be determined within this framework.

During the house arrest process, prisoners are monitored using control mechanisms such as electronic ankle monitors. If the prisoner violates their obligations, the postponement decision is revoked by the Chief Public Prosecutor's Office. There is a right to appeal this decision to the execution judgeship.

HEALTH STATUS WILL BE REVIEWED EVERY YEAR

The decision to postpone the sentence is re-evaluated in one-year intervals. If there is no change in the health condition, the postponement of the sentence can continue. However, if it is determined through reports that the prisoner has recovered, the postponement of the sentence is terminated.

WHAT HAD HAPPENED?

A new resolution process had come to the agenda again with the call of MHP leader Devlet Bahçeli. In his speech at his party's group meeting, Devlet Bahçeli said regarding PKK leader Öcalan, "Let Öcalan come out and speak at the DEM Party group, let him announce that he has disbanded the PKK. In return, let him benefit from the right to hope." Following this statement, support also came from the DEM Party.

In the subsequent process, DEM Party members Sırrı Süreyya Önder and Pervin Buldan met with Öcalan in İmralı.

Following the meeting, the leader of the PKK terrorist organization, Öcalan, issued a written statement.
