New development in CHP's complaint against Akın Gürlek to the HSK

The Republican People's Party (CHP) had filed a complaint with the HSK against Istanbul Chief Public Prosecutor Akın Gürlek and two prosecutors, alleging "misconduct in office" and "violation of the confidentiality of an investigation" regarding a corruption probe into the Istanbul Metropolitan Municipality. However, this complaint was not processed by the HSK.

CHP Chairman Özgür Özel had submitted a parliamentary question to Minister of Justice Yılmaz Tunç regarding the matter through the Speaker of the Grand National Assembly of Turkey (TBMM). In his motion, Özel requested that Tunç respond within the 15-day constitutional period. In his response, Tunç did not address the content of the allegations but instead cited constitutional articles stating that judicial power shall be exercised by independent and impartial courts.

THE HSK'S DECISION AND TUNÇ'S RESPONSE

Minister of Justice Tunç emphasized that the investigation process is confidential and that prosecutors have the authority to conduct necessary inquiries. He further stated that the ministry does not possess information or documents regarding such investigations.

Tunç noted that investigations into crimes committed by lawyers during the performance of their duties can be conducted with the permission of the Ministry of Justice, but that in cases of flagrante delicto involving crimes within the scope of the high criminal court, investigations can be carried out directly by prosecutors.

In the HSK's decision regarding the CHP's complaint, it was announced that the decision not to process the complaint was made by the First Chamber of the Council on July 23, 2025, and approved by the President of the Council on July 29, 2025. Furthermore, it was stated that proceedings regarding the decision not to process the complaint concerning allegations referred to as the "IMM Case Exchange" are ongoing and that the file is currently before Tunç in his capacity as the President of the HSK.
