New development in the diploma crisis: Another objection from Ekrem İmamoğlu!

Istanbul Metropolitan Municipality Mayor Ekrem İmamoğlu, who is being held at Silivri Prison, has filed a new objection following the rejection of his request for a stay of execution against the cancellation of his undergraduate diploma. The objection was filed on the grounds that the court's decision was "contrary to law."

İMAMOĞLU DEEMS THE DECISION “CONTRARY TO LAW”

According to the report in HaberTürk, İmamoğlu’s lawyers pointed out that the court's decision regarding the stay of execution request was made by a duty judge and members instead of the original panel, stating that this situation is contrary to the principle of seeking justice and the principle of the natural judge. The lawyers described this situation as a “clear violation of the law.”

In the petition of objection, İmamoğlu’s lawyers stated the following:

“While the request for a stay of execution should have been decided by the original panel of the court authorized and tasked to hear the case, for some reason, the panel was changed, a new panel was appointed, and furthermore, by assigning a ‘duty president and duty members,’ our request for a stay of execution was rejected with a sentence consisting merely of a repetition of the legal provision without any justification; this is clearly contrary to the law and violates the principle of the natural judge, as well as our client's freedom to seek justice and the right to a reasoned decision.”

The lawyers argued that the rejection of the decision without justification violates the principle of the natural judge, which is guaranteed by the constitution, and asserted that İmamoğlu’s freedom to seek justice has been restricted.
