Representatives from the CHP, Gelecek Party, DEM, Democrat Party, and EMEP had made a statement at the Parliament and collected signatures to call for an extraordinary session.
It was learned that the opposition reached the required number of 120 signatures for the session.
Parliament Speaker Numan Kurtulmuş called the Grand National Assembly of Türkiye General Assembly to convene on Friday, August 16, 2024, at 14:00, in accordance with Article 93 of the Constitution and Article 7 of the Rules of Procedure of the Grand National Assembly of Türkiye.
Whether the Constitutional Court's decision will be read in the General Assembly remains a subject of debate.
THE CONSTITUTIONAL COURT'S CAN ATALAY DECISION
The reasoning behind the Constitutional Court's decision regarding the revocation of TİP Hatay Deputy Can Atalay's parliamentary membership, which occurred after the decision of the 3rd Criminal Chamber of the Court of Cassation was read in the General Assembly, was published in the Official Gazette.
In the decision, which stated that a de facto situation was created by reading the letter from the 3rd Criminal Chamber of the Court of Cassation—which clearly did not contain a final conviction regarding Can Atalay—in the General Assembly, it was noted that "it is not possible for the Constitutional Court to make a decision regarding this de facto situation."
The Court ruled that "there is no need to make a decision regarding the request for the determination that the revocation of Can Atalay's parliamentary membership is null and void, and for its annulment in accordance with Article 85 of the Constitution."
