TİP statement on 'constitutional coup': Criminal complaint filed against Court of Cassation members and AKP and MHP executives
The Court of Cassation 3rd Criminal Chamber's statement that "the Constitutional Court's ruling on rights violations has no legal value," issued in response to the Constitutional Court's "rights violation" decision, has sparked public backlash. The Workers' Party of Turkey (TİP) announced that they will file a criminal complaint against the members of the Court of Cassation and the executives of the AKP and MHP.
The Court of Cassation 3rd Criminal Chamber stated that there was no decision that could be implemented under Article 153/6 of the Constitution regarding the case of TİP Hatay MP Can Atalay, and argued that the Constitutional Court's ruling was an act of "juristocracy."
CRIMINAL COMPLAINT TO BE FILED
In a statement regarding the matter, TİP noted the following:
"The Central Executive Board and Party Assembly of the Workers' Party of Turkey convened following the Court of Cassation 3rd Chamber's decision regarding Can Atalay, which constitutes a judicial coup against the Constitution, and has taken the following decisions:
1- The Workers' Party of Turkey will not accept the disregard for the popular will, the failure to recognize the clear provisions of the Constitution and the rulings of the Constitutional Court, or the imprisonment of the people's representatives or our citizens due to their political views. Tyrannical practices cannot be normalized, and we cannot and will not remain spectators as Turkey turns into a dictatorship. We will fight resolutely and en masse across the entire country against this judicial coup.
2- Efforts have been initiated to create a common democracy platform where all opposition forces, our citizens, political parties, democratic mass organizations, and legal organizations can come together to say stop to this constitutional coup and demand justice and freedom.
3- Contact has been made with opposition parties and the Speaker of the Parliament to call the Grand National Assembly of Turkey (TBMM) to an extraordinary session as soon as possible to address the constitutional coup.
4- A criminal complaint will be filed against the members of the Court of Cassation who dared to trample on the Constitution, as well as the executives of the Justice and Development Party (AKP) and the Nationalist Movement Party (MHP) who encouraged them in these putschist actions."
