MHP's Yıldız comments on 'Constitutional Court' from the parliamentary podium: 'It cannot give orders or instructions'

Speaking during the Turkish Grand National Assembly (TBMM) budget negotiations, MHP Deputy Chairman Feti Yıldız made statements from the parliamentary podium regarding the second application made to the Constitutional Court (AYM) by imprisoned TİP MP Can Atalay. Yıldız stated, "The Constitutional Court cannot establish a hierarchical relationship with other courts, nor can it give orders or instructions."

Speaking during the TBMM Budget Negotiations, MHP Deputy Chairman Feti Yıldız addressed the assembly from the parliamentary podium while the second application to the Constitutional Court (AYM) by imprisoned TİP MP Can Atalay was being discussed.

Yıldız stated the following:

"Retrial under Article 50 of the Constitutional Court's establishment law and the renewal of proceedings under Article 311 and subsequent articles of the Criminal Procedure Code (CMK) are different from each other. Unfortunately, even prominent legal experts are confusing the two. We are trying to explain it here; unfortunately, in an individual application, the decisions of the Court of Cassation are also being reviewed. The Constitutional Court cannot establish a hierarchical relationship with other courts, nor can it give orders or instructions," he said.
