Insult case against Musa Orhan! 'He has turned it into a source of income'

İpek Er, who attempted suicide with a handgun in the Beşiri district of Batman and passed away in the hospital 34 days later on August 18, 2020, wrote in a letter she left behind that expert sergeant Musa Orhan, who was stationed in Siirt, had sexually assaulted her. A lawsuit was filed against Orhan at the Siirt 1st High Criminal Court, seeking a prison sentence of no less than 12 years for the crime of 'Qualified sexual assault.' The non-detained defendant Orhan, through his lawyer, has filed 'Insult' lawsuits against Günay Bilbay, a resident of Mardin, following similar actions against actors Ezgi Mola, Farah Zeynep Abdullah, and Hazal Kaya, who had expressed their reactions on social media. In the verdict hearing held on October 10 at the Ankara 87th Criminal Court of First Instance, defendant Günay Bilbay was sentenced to a judicial fine of 1,740 TL, equivalent to 87 days, on the grounds that she insulted Musa Orhan in a social media comment. Additionally, it was ruled that 30,000 TL in attorney fees and 592.60 TL in litigation costs be collected from Bilbay.

'I COULD NOT GRIEVE FOR MY DECEASED MOTHER'

Stating that she did not make the post herself, that her social media account was hacked, and that she was reported on the day her mother died, Günay Bilbay said, "My mother was ill and receiving treatment in the hospital. On January 8, 2021, the day my mother passed away, I was taken to the police station due to the complaint and forced to give a statement. I could not grieve for my mother at all. That was the first time I became aware of the incident involving our young girl. If I had made a status or a post, I would have written it without using insults. But I was very busy at that time and definitely did not make any comments. I do not accept these accusations. None of our girls who were murdered or our women who died deserve death. I am experiencing this victimization just like them. After the incident, I developed high blood pressure and diabetes. I started having insomnia problems; I lost my health. I am calling out to our Minister of Justice, our judges, and our prosecutors; I want to file a criminal complaint against them. If something happens to me, the reason and the culprit for it will be Musa Orhan and his lawyer."

'MUSA ORHAN HAS TURNED THIS INTO A SOURCE OF INCOME'

Günay Bilbay's lawyer, Gurbet Bilbay, stated that although the competent court should have been in Mardin, the trial was held in Ankara courts, and said the following:

"Despite my client stating repeatedly, 'My account was hacked, those writings do not belong to me. I was taking care of my mother at that time, I was my mother's guardian,' and presenting evidence proving this situation, she was still sentenced. Initially, my client was tried under the simple trial procedure. A decision was made that there was no need to impose a penalty. Subsequently, the defendant's lawyer appealed the final decision. In his justification, the defendant's lawyer said, 'My client will most likely be acquitted in the sexual assault case.' The court accepted the appeal, and my client was sentenced. I would not be surprised if the defendant is acquitted. After being acquitted, he will file a lawsuit at the high criminal court claiming he was detained for 7 days, collect compensation for that, and return to his profession.

The public who commented and supported are also being tried once again. I am calling out to the judges and prosecutors here: while there is so much violence against women, abuse, and sexual assault on the agenda, why are these types of decisions being made? In this process, those who supported the victimized woman were tried one by one and received sentences. The defendant has turned these lawsuits into a source of income, and the public has been put on trial. The defendant will continue to file compensation lawsuits again."
