Non-prosecution decision regarding Fenerbahçe's complaint over post-Galatasaray derby incidents

In the non-prosecution decision prepared by the Istanbul Chief Public Prosecutor's Office, it was stated that the investigation was initiated upon the complaint filed by Fenerbahçe Sports Club, Fenerbahçe Football Inc., and the club's doctor, Ertuğrul Karanlık, through their lawyers against Rams Park stadium manager Ali Çelikkıran, Galatasaray Sports Club Board General Secretary Eray Yazgan, and Galatasaray footballer Aktürkoğlu for the crimes of "causing disorder in sports areas," "intentional injury," "robbery," "preventing the exercise of freedom of belief, thought, and opinion," "insult," and "inciting the public to hatred and hostility or degrading them."

The non-prosecution decision included the complainants' allegations that after the derby, the Fenerbahçe football team was taken to the locker room without being allowed to celebrate their victory or take photos, and that Fenerbahçe executives, players, and technical staff wanted to go onto the pitch to take photos but were prevented by Galatasaray officials and subjected to physical and verbal intervention.

The decision, which included the petition claiming that while some Fenerbahçe members were taking photos at the center circle, Ali Çelikkıran approached them with curses, threats, and insults, attacked the Fenerbahçe team, and that Karanlık was assaulted by Çelikkıran, stated that Çelikkıran's statement was taken as part of the investigation.

The decision stated that there was no concrete allegation or evidence that Aktürkoğlu and Yazgan, who were the subjects of the complaint, committed acts during the incidents that could be considered under the crimes of "insult" and "intentional injury" against Karanlık.

STATED THAT THERE WAS NO CAMERA RECORDING

The decision, which reported that the complaint petition did not contain any determination as to which acts by Aktürkoğlu and Yazgan constituted which crimes, and that their names were only written as suspects, stated that there was no camera footage showing Aktürkoğlu and Yazgan intervening in the argument between Çelikkıran and Karanlık during the photo session with the Fenerbahçe flag.

The decision emphasized that although it was alleged that Çelikkıran attacked Fenerbahçe players, the team doctor, and executives and seized the Fenerbahçe flag, no such situation was encountered in the camera recordings.

The decision explained that it was seen that Çelikkıran reached for the Fenerbahçe flag during the photo session to prevent the photo from being taken, and that Çelikkıran did not use force or violence, and that this situation could not fall under the scope of the crime of "robbery."

INDICTMENT PREPARED AGAINST 5 SUSPECTS

Regarding the incidents that occurred after the match, an indictment had been prepared by the Istanbul Chief Public Prosecutor's Office against footballers Jaden Quinn Oosterwolde and Mert Hakan Yandaş, Fenerbahçe Club doctor Ertuğrul Karanlık, former Fenerbahçe executive Hulusi Belgü, and technical director İsmail Kartal's son Emre Kartal, requesting prison sentences ranging from 2 years and 3 months to 6 years and 9 months each for the crimes of "intentional injury resulting in bone fracture or dislocation" and "causing disorder in sports areas and damaging facilities."

NON-PROSECUTION DECISION HAD BEEN ISSUED FOR 17 PEOPLE

In the indictment, it was stated that during the incidents that took place on the pitch after the match, the suspects acted in unity of intent and action, and assaulted the only complainant in the file, Çelikkıran, by kicking and punching him.

The indictment, which stated that a non-prosecution decision was issued for 17 people, including Fenerbahçe Sports Club President Ali Koç, Bright Osayi Samuel, İrfan Can Eğribayat, and some members of the Fenerbahçe board of directors, was sent to the Istanbul 3rd Criminal Court of First Instance.
