In the statement, it was reported that foreigners currently in the US on temporary visas will now only be able to apply for permanent residency from their home countries, except in mandatory circumstances.
The USCIS statement indicated that the decision was made to prevent "exploitation of loopholes in the system." It was stated that the regulation aims to prevent individuals whose permanent residency requests are denied from remaining in the US illegally.
The statement pointed out that individuals who enter the country on student, temporary work, and tourist visas are in the US for a specific duration and purpose.
In the assessment made by USCIS, it was stated: "The system is designed for (these individuals) to leave the country when their visits conclude. Their visits should not be considered the first step of the Green Card process."
