A decision from the court that wounds the conscience: Treatment costs of the late Nihat Genç are being demanded back

A shocking outcome has emerged in the lawsuit filed by the Social Security Institution (SGK) to recover the cost of medication for the late author and founder of Veryansın TV, Nihat Genç, who passed away while battling lung cancer. The SGK had previously covered the third dose of his smart medication, but the court has now ruled that the amount in question must be returned to the institution.

The court announced its verdict in the case concerning the smart medication used in the treatment of Nihat Genç, who passed away on July 4 due to lung cancer. Genç's lawyer, Ersan Barkın, made a statement regarding the legal process via social media.

"HE COVERED THE FIRST TWO DOSES WITH HIS OWN MEANS"

Lawyer Ersan Barkın stated that Nihat Genç had procured the first two doses of the smart medication used in his treatment through his own means. He explained that the third dose was obtained on credit from a pharmacy and that a lawsuit was filed to have the SGK cover this cost.

Barkın announced that while the court initially approved an injunction, the decision was overturned following an appeal by the SGK on the grounds that "the plaintiff's justification and damages could not be sufficiently proven." He noted that the decision was unanimous and that there is no further right to appeal. The lawyer's post included the following remarks:

"I want to tell you about an author, a leader of society. Someone with a high pain threshold, tough enough to resist even lung cancer. They could only force him to see a doctor in the final stage. Treatment began rapidly at a state hospital. They sought a way to slow the process with a smart drug. Each dose costs a fortune. Naturally, there was no power to pay. His lawyer applied to the SGK, to which he had paid premiums for years."

The request was rejected on the grounds that the drug was not on the list of covered medications. There was no path left but to file a lawsuit.

They bought the medication from the pharmacy on credit, with the agreement to pay once it was collected from the institution. A conscientious judge, perhaps knowing that many citizens who file such lawsuits do not live to see the end of them, accepted the request for an injunction. He was able to receive the 3rd dose. Afterward, the illness had already engulfed his body. Intubation, intensive care. We lost him... Meanwhile, the institution had filed an appeal against the injunction request. We buried him...

The Court of Appeal rendered a decision in the name of the "Turkish Nation": Unanimously, and with no further right to appeal, it overturned the decision (regarding the coverage of the drug cost by the institution) on the grounds that "the plaintiff's justification and damages could not be sufficiently proven." The party referred to as the plaintiff in the decision has passed away... The Turkish Nation, in whose name the decision was made, overflowed from the courtyards.
