ABK Case: 'Police took revenge on MHP'

Serdar Sertçelik, a secret witness continuing his defense in the Ayhan Bora Kaplan case, argued that messages created on a "found phone" allegedly belonging to him were fake. While claiming that the name of former Health Minister Fahrettin Koca was added to the list later, Sertçelik alleged that a "slander and revenge operation" was carried out against certain politicians, members of the judiciary, and journalists through the correspondence in question.

Serdar Sertçelik, the M7-coded secret witness in the Ayhan Bora Kaplan criminal organization case, stated that the messages created on a found phone allegedly belonging to him were used to take revenge for MHP Leader Devlet Bahçeli labeling police officers as "coup plotters." He also stated that although his name was not mentioned in his conversations with the then-KOM Branch Manager Şevket Demircan, former Health Minister Fahrettin Koca was added to the list via the aforementioned found phone.

The defense of Serdar Sertçelik continued today at the Ankara 32nd High Criminal Court, where the trial of 76 defendants has been re-heard since last week following the partial reversal and consolidation decisions of the Court of Appeal.

"AM I THE HEAD OF INTELLIGENCE?"

Explaining that documents received from Hungary via the Ministry of Foreign Affairs confirmed that he was in prison during the dates when the messages, emails, and calls on the found phone were made, that he had no access to a mobile phone in prison, and that he was only allowed to speak with numbers registered in the system, Sertçelik pointed out that during the correspondence conducted through our Embassy regarding him, Hungarian authorities noted, "There are contradictions between the government and the court."

Using the expressions "God's plagues, frauds" for the individuals he claims created the found phone, Sertçelik alleged that these people were protected at every stage of the investigation and accused the investigation prosecutor Mustafa Kaya as follows:

"Instead of asking me whether I could have made these correspondences while I was in Hungarian prisons, he told me rumors that former Interior Minister Ali Yerlikaya was working for my extradition during his meeting with the Hungarian Interior Minister in Istanbul. What business do you have with these rumors?"

Claiming that the email, X, and Instagram accounts opened in his name on the fake phone were used by the same person, Sertçelik also said the following regarding a 14-page email sent to some state institutions in his name:

"Am I the head of intelligence? Where would this much information traffic come to me from? Even the head of intelligence wouldn't know this much. This information could only be with the police intelligence chief, or with the KOM Manager who brought this setup upon me."

While drawing attention to certain expressions in the correspondence, Sertçelik said, "There are many expressions used by Şevket Demircan. Only Şevket Demircan calls Nurullah Özgür Kopuk 'Nuri'. In these correspondences, he is also called 'Nuri'. I never said Nuri."

"FAHRETTİN KOCA WAS NOT THERE"

Reminding that in the conversations Şevket Demircan had with him after he fled Turkey, he asked him to name Bekir Bozdağ, Mücahit Aslan, Hasan Doğan, and Osman Aslan, Sertçelik emphasized that the name of former Health Minister Fahrettin Koca was never mentioned in these conversations, but that he was now added to the list with the correspondence on the found phone.

Continuing his defense by reading the messages on the phone one by one, Sertçelik claimed that he definitely did not give a nickname to a minister, and that the person who gave this nickname was Şevket Demircan; the Presiding Judge warned him not to say the nickname. When Sertçelik said about a judge mentioned in the correspondence, "This judge is the man who lifted a non-prosecution decision in this case. Either they fell out with them or they have other calculations, they included him too," the President stated that these were not the subject of the trial and asked him to just say it and move on. Sertçelik replied, "Then they would have achieved their goal. They shouldn't achieve their goals."

"HE SHOUTED IN THE COURTHOUSE CORRIDOR"

Explaining that with the messages on the found phone, revenge was taken on names such as Sabah Newspaper, Abdurrahman Şimşek, and Nedim Şener, who fight against "FETÖ," and that İsmail Saymaz was also included, Sertçelik continued as follows:

"They didn't forget to take revenge on the MHP either. They took revenge for the speech Devlet Bahçeli made in the group. Who are we to prepare such a speech text? They exaggerated, they talked nonsense. They also took revenge by slandering Veysel Kaçmaz (Ankara Deputy Chief Public Prosecutor), who is known for his closeness to the MHP. Everyone knows that they hold Veysel Kaçmaz responsible for the detention and arrest of the police officers, and that Murat Çelik even shouted in the courthouse corridor, 'Veysel Kaçmaz, we will see you'."

When Sertçelik moved on to a message about another member of the judiciary, saying "The honor of your colleague has been insulted," the Presiding Judge intervened, saying "everyone read it, saw it." Upon this, Sertçelik said, "If Mustafa Öztaş, who is responsible for these, escapes, you cannot find who had it done. These people are so filthy, so bad inside. Mustafa Öztaş presented himself here as if he were Trump's partner. Whereas he is a real estate agent. He has a pile of criminal records. He said he didn't know me. He is someone close to the police chiefs of every era. He would come to my venues many times with them, sit in the booths, drink until morning, and leave without paying a penny."

Noting that Prosecutor Mustafa Kaya gave the entire file to the police while not giving them a single document on the grounds that there was a confidentiality order, and that they presented this as evidence in the administrative and judicial investigations against them, Sertçelik concluded his defense as follows:

"Whoever created this fake phone is dishonorable, despicable; they are people who have no God or book. May God plague them. They slandered a pile of people, members of the judiciary, and politicians. Let's find those who did this. Is our state that helpless? If the man who did this escapes, your panel will be responsible. The interlocutors of everyone mentioned in these correspondences are Murat Çelik, Şevket Demircan, Mustafa Öztaş, Attorney R.Ö., and Attorney T. I proved with evidence that I was in prison on the dates in question. I think that our state will arrest them sooner or later and everything will be clarified."

After his defense, the Presiding Judge stated that it was alleged that he was threatened by Bora Kaplan and asked if he wanted to be a complainant. Sertçelik said, "Those emails do not belong to me. I am not a complainant."
