Ali Kaya indictment crisis between Bodrum and Istanbul courts: Dispute at the Court of Cassation

The Bodrum 2nd High Criminal Court has sent the file regarding Ali Kaya, the imprisoned brother of Dilek Kaya İmamoğlu—the wife of Istanbul Metropolitan Municipality (İBB) Mayor Ekrem İmamoğlu, who is being tried in the İBB case—back to Istanbul, stating that the jurisdiction for the trial lies in Istanbul. As a result of the jurisdictional dispute between the Istanbul and Bodrum courts, the file has been sent to the relevant criminal chamber of the Court of Cassation for a determination of venue.

An indictment was prepared in recent weeks by the Istanbul Chief Public Prosecutor's Office against Ali Kaya, the imprisoned brother of Dilek Kaya İmamoğlu—the wife of Ekrem İmamoğlu, who is being tried in the İBB case—on charges of "trading or supplying narcotic or stimulant substances."

During the indictment acceptance process, the file was sent to Bodrum.

However, the Bodrum 2nd High Criminal Court issued a decision of lack of jurisdiction, citing that the crime scene was in Istanbul and all procedural actions were carried out in Istanbul.

The court ruled that the jurisdiction for the trial lies in Istanbul and ordered the file to be sent to the Istanbul 7th High Criminal Court.

Thus, a jurisdictional dispute arose between the Istanbul and Bodrum courts.

For this reason, it was decided that the file be sent to the relevant criminal chamber of the Court of Cassation for a determination of venue.

The relevant criminal chamber of the Court of Cassation will decide in which court the trial will be held. 

On the other hand, it was also ruled that the detention of Ali Kaya, who was previously arrested, shall continue.
