Application filed with the Constitutional Court for Zeydan Karalar

Hüseyin Ersöz, the lawyer for Adana Metropolitan Municipality Mayor Zeydan Karalar, who was detained and arrested on July 5 as part of a 'corruption' investigation into municipalities in Adana, stated that they have filed an individual application with the Constitutional Court.

"CONTRARY TO THE PROHIBITION OF MISUSE OF AUTHORITY"

In his post, Ersöz stated the following:

"We have filed an individual application with the Constitutional Court on behalf of Adana Metropolitan Municipality Mayor Zeydan Karalar (@ZeydanKaralar01). In the application, we stated that the detention and arrest decisions not only constitute a violation of the Right to Liberty, but also that the Istanbul Chief Public Prosecutor's Office lacked jurisdiction in the investigation against Zeydan Karalar, that unlawful practices such as the restriction order and the failure to summon lawyers to detention reviews created the impression that they were carried out for political purposes, and that this situation constitutes a violation of the Prohibition of Misuse of Authority: "... at this point, we would like to draw attention to one more issue.

As stated in the facts and evidence section, the continuation of detention was decided by the Istanbul 6th Criminal Judgeship of Peace with its decision dated 31/07/2025 and numbered 2025/8731 D. İş. While this decision was being made, the applicant's statement was taken via SEGBİS. However, although the applicant's statement was included in this decision with the title of "suspect", the applicant's name was not even written after the "It is decided as follows" heading, and the names of other individuals whose detention was being reviewed were included. This fact alone shows how careless and sloppy the detention reviews are. ... In some news reports reflected in the press, it was stated that an investigation was initiated upon an e-mail received by the Istanbul Police Department's e-mail address in September 2024 regarding allegations concerning the Kütahya Municipality and some district municipalities in Istanbul, that the files were subsequently separated, and that the file was sent to Kütahya on 08/10/2024 after a decision of lack of jurisdiction was made regarding the investigation into the allegations concerning the Kütahya Municipality. The same situation applies to the accusations against the applicant, and it is understood that the investigation should be conducted by the Adana Chief Public Prosecutor's Office.

When looking at the investigation conducted regarding the applicant, there is no public interest in restricting access to the investigation file, and the prosecution has not been able to demonstrate such a public interest. Due to the aforementioned access restriction, objections to the applicant's detention could not be carried out effectively; no justification was provided other than the mention of legal regulation regarding the restriction of access and its continuation. For all these reasons, the applicant's right to personal liberty and security has been violated once again.

It is unlawful to issue an arrest warrant based on issues that do not correspond to material facts despite the absence of conditions for arrest, and not to lift this decision. Considering that the Mayor of Adıyaman, who was detained on July 5 on similar charges, was not arrested, was released with judicial control in the form of house arrest, and that this measure was subsequently lifted, suspicions arise that the detention of the applicant and the subsequent proceedings were carried out for political purposes and constitute a misuse of authority." In the application, in accordance with Article 73 of the Internal Regulations of the Constitutional Court, we also requested that the High Court implement an interim measure, noting that Zeydan Karalar is an elected mayor and that "there is a serious danger to his fundamental rights."
