Attention stingy husbands: Court of Cassation finds full fault

In a divorce case in Denizli, a husband who did not buy household goods and prevented his wife from using appliances to save on electricity, forcing her to cook on a camping stove, was found to be fully at fault.

The 2nd Civil Chamber of the Court of Cassation has ruled that a husband who did not buy household goods, did not allow appliances to be installed to save on electricity, and forced his wife to cook on a camping stove in a divorce case was fully at fault.

The court, which decided on the couple's divorce, ordered the husband to pay 15 thousand lira in material compensation.

DEMAND FOR MATERIAL AND MORAL COMPENSATION

In a mutual divorce case filed in Denizli, the plaintiff-defendant husband argued that his wife, who treated him disrespectfully, did not cook or clean at home, and that he was forced to do these chores himself.

Stating that his wife left the house after a while, the husband claimed that she did not return home despite him sending messages through relatives many times. The husband, who requested that their divorce be granted, also demanded 50 thousand lira in material and 50 thousand lira in moral compensation.

"HE CHECKS THE MONEY IN MY POCKET EVERY MORNING"

The defendant-plaintiff wife stated in her petition that her husband did not buy the basic necessities for the house and did not allow the appliances to be installed because they would consume electricity. Stating that her husband accused her of theft, the woman alleged that he checked the money in her pocket every morning.

Stating that her husband kicked her out of the house and that she could not return because he changed the door lock, the woman requested 50 thousand lira in material and 100 thousand lira in moral compensation.

The Denizli 4th Family Court considered the man's failure to establish a household order, the fact that the woman had to cook on a camping stove, and his changing of the house locks upon realizing his wife had left the house as faults.

RULED THAT THE WOMAN HAD NO FAULT

Finding the man fully at fault in the divorce case, the court ruled that the woman had no fault. The court decided that 15 thousand lira in material compensation should be given to the woman.

Upon the husband's appeal of the decision, the 2nd Civil Chamber of the Antalya Regional Court of Justice, which reviewed the file, rejected the appeal on its merits on the grounds that the local court's decision was in accordance with procedure and law.
