Today, the second session of the first hearing in the newborn case began. 12punto is following the case moment by moment.
The presiding judge took his place in the courtroom. The defendants were brought in. The green shirt worn by Fırat Sarı drew attention.
The presiding judge and the defendants arrived at the court.
All defendants in custody took their places in the courtroom. The lawyers for the complainants and the relatives of the complainants also took their places. Attendance at the hearing is lower than yesterday.

The presiding judge is reading the requests for participation from bar associations and lawyers.
10.50
The presiding judge issued a warning against speaking without permission during the hearing. He stated that he would have anyone removed if the discipline is disrupted.
In his testimony yesterday, Hakan Doğukan Taşçı had stated that Hasan Basri Gök managed the flow of money under the instructions of Fırat Sarı.
The presiding judge called defendant Hasan Basri Gök to the stand.
IT IS HAPPENING IN ALL PRIVATE HOSPITALS
11.06
Presiding Judge: In the case filed against you, you are charged with forgery of official documents, fraud, and membership in a criminal organization. Will you make your defense?
Defendant Hasan Basri Gök: I explained the necessary things at the prosecutor's office and at the police station; there is no need to explain them again.
Presiding Judge: Is it true?
Defendant Hasan Basri Gök: Most of them are things I know and have seen with my own eyes.
Presiding Judge: Can you explain the changing of epicrises?
Defendant Hasan Basri Gök: Fırat Sarı had an Excel system. Values were entered into that template.
Presiding Judge: Are these normal values, or the values you changed?
Defendant Hasan Basri Gök: The values entered by the person in charge on the other side.
Presiding Judge: Which hospitals did you work at?
Defendant Hasan Basri Gök: I worked at Reyap, Silivri Kolan, and Duygu hospitals. I worked at Reyap between 2019-2021, then at Duygu Hospital, and finally at Kolan.
Presiding Judge: What was your acquaintance with Fırat Sarı like?
Defendant Hasan Basri Gök: I was normally a nurse. In the last 6 months, I helped with the template work. In the 6 months after that, I was his driver. Regarding the operation, Fırat Sarı would meet with the hospital administrators and say that he would operate the intensive care units.
Presiding Judge: Which hospitals were these?
Defendant Hasan Basri Gök: Private Reyap Hospitals, Avcılar Hospital, Doğu Hospital, Silivri Hospital, Duygu Hospital, Bağcılar Şafak, GOP Şafak Hospital, and Güney Hospital.
Presiding Judge: What do you know about baby referrals?
Defendant Hasan Basri Gök: They were taken from 112, hospitals, and medical centers. The doctor working at the medical center was a friend of Fırat Sarı. Referrals were coming without 112 intervening.
Presiding Judge: Why was it done?
Defendant Hasan Basri Gök: To get more money from the SGK (Social Security Institution).
Presiding Judge: How was he earning?
Defendant Hasan Basri Gök: I haven't seen anything with my own eyes, but no one does anything for free.
Presiding Judge: Why didn't you discharge the Serdorova baby?
Defendant Hasan Basri Gök: They didn't discharge it because they didn't pay. It was a heart patient. It was at the 3rd level. The first hospital didn't discharge it either.
Presiding Judge: When the saturation was low, were you saying, "Should we not continue the treatment?"
Defendant Hasan Basri Gök: What should normally be done is to continue treatment until the kidneys fail. After that, it is stopped.
11.49
"DOESN'T 112 AUDIT THIS?"
Presiding Judge: Did you see Hakan Doğukan introducing himself as a doctor?
Defendant Gök: Yes.
Presiding Judge: When did you see it?
Defendant: When Mr. Şehmus was not there. Şehmus Çelik could not be reached after 12. Hakan Doğukan's number was in the 112 system.
Presiding Judge: Isn't the doctor asked, doesn't 112 audit this?
Defendant: No, sir.
Presiding Judge: Is it that simple to change the number?
Defendant: If you are registered, you can enter and change it yourself.
Presiding Judge: Do you have any information about the Kaya Baby?
Defendant: It was referred from Esencan.
Presiding Judge: There is money inflow and outflow between Hüseyin Gündüz and Hakan Doğukan. What do you say to that?
Defendant: I don't know, it could be an EFT.
Presiding Judge: Do you have any information about the Opera Baby?
Defendant: It was referred from Medilife. It shouldn't have been referred. Mr. Şehmus says "I have no news," but which baby did he have news about anyway? He never showed the necessary care.
"IF THEY HAD NOTICED, IT WOULD BE ALIVE"
Presiding Judge: What do you know about the death of the Opera Baby?
Defendant: I know it was referred from Medilife. I know that Doğukan left the baby stable and it died the next day. Also, I know that Tuğçe and Doğukan talked about this. The night nurses didn't notice either.
Presiding Judge: Didn't they notice, or couldn't they notice?
Defendant: If they had noticed, it would be alive right now.
11.58
"HE WAS Fırat Sarı'S ADVISOR"
Presiding Judge: Were you acting as Fırat Sarı's assistant?
Defendant: I was.
Presiding Judge: Was there anyone else?
Defendant: There was. Sümeyye Nur Arslan. Most of the work was already with Sümeyye. She was like Fırat Sarı's advisor anyway.
12.08
"HE KNEW ABOUT THE IRREGULARITIES"
The presiding judge asked about Ahmet Atilla Yılmaz, the Chief Physician of Medilife, who was mentioned in the newborn gang incident and resigned from the CHP Council membership.
Presiding Judge: You said that Ahmet Atilla Yılmaz was aware of the irregular step system. Was he aware, or is this your interpretation?
Defendant Hasan Basri Gök: Fırat Sarı would go and explain these, meet, and make presentations. Fırat Sarı didn't get these jobs through a tender anyway; he got them by explaining his promises. There were slides, he was making presentations over them. There was no situation where a chief physician would not be aware of these. He was aware of the irregularities.
12.26
Ahmet Davutoğlu, Chairman of the Future Party (Gelecek Partisi), arrived at the courtroom.
12.34
THE PROSECUTOR ASKED ABOUT THE TAPE WHERE THEY SAID THEY WOULD PARTY
Prosecutor: In the tapes, you say give this medicine to the babies little by little. I know it is a medicine that should be intubated if given to children.
Defendant: There is no such situation. It was a nonsensical conversation.
Prosecutor: Why do you insist on a medicine you won't give? It didn't seem like a very nonsensical conversation to me.
Prosecutor: Is there a medicine to take healthy babies to the newborn unit like this?
Defendant: No, Prosecutor. No one would do such a thing, and we don't have it!
Prosecutor: I am asking about your conversation with Hakan Doğukan. You are talking about a heart patient. You are talking about partying with 140 thousand liras.
Defendant: Such an operation did not happen.
Prosecutor: Which child is this?
Defendant: It could be Turkmen.
"YOU SAY THE STATE WILL SCREW US"
Prosecutor: You say, "Let it not die and stay on our hands, the state will screw us." Do you feel you have a responsibility in your own way?
Defendant: The baby needed to have an operation, it didn't. It needed to be referred, it wasn't.
Prosecutor: Is this child the Serdorova Baby?
Defendant: I think so.
Prosecutor: What was the hierarchy in the operation? Were you communicating directly with Fırat Sarı or were there intermediaries?
Defendant: Everyone could contact Fırat Sarı. Fırat and İlker were in the foreground because they were doctors. Other than that, there was nothing, everyone could communicate.
"YOU SAY THE BABY COULD BE ALIVE"
Cross-examination of Hasan Basri Gök:
Victim's lawyer: You say, "Doğukan, leave that esmeron, buddy"? What is this esmeron?
Hasan Basri Gök's lawyer objected to the question. It was decided that the question could be asked.
Hasan Basri Gök:
What esmeron is used for is already clear. Just stopping the medicine and calling Doğukan and saying there is nothing to do in the morning... I don't know.
Victim's lawyer: Why is Hakan Doğukan Taşçı at the hospital around 9 in the morning? Do you have any information?
Hasan Basri Gök:
I don't know, I wish they had called a proper physician instead of waiting for Doğukan.
Victim's lawyer: You say, "The baby could be alive"?
Presiding Judge: Which baby?
Victim's lawyer: Opera baby.
It would be better if there was an expert report on this, after all, I am a nurse.
Did you work with Doctor Şehmus Çelik!?
Hasan Basri Gök: No
Did Hakan Doğukan Taşçı call 112 himself and register himself as Şehmus Çelik saying it was my new phone?
Hasan Basri Gök: Yes, but Şehmus Çelik knew about it.
Şehmus Çelik's lawyer: Did you form an organization?
Presiding Judge: We don't ask the question this way. The question has not been accepted.
Şafak hospitals lawyer: You also counted Bağcılar Şafak hospital. Neonatal intensive care service has not been provided at Gaziosmanpaşa Şafak hospital for many years, including during the investigation process. What kind of operation process are you talking about?
Hasan Basri Gök's lawyer objected.
It was decided that this question should not be asked.
Şafak hospitals lawyer: Did you see İlker Gönen go to Bağcılar hospital?
Hasan Basri Gök: I didn't see him, after all, I don't wait at the hospital door.
13.10
AHMET DAVUTOĞLU AND HIS WIFE AT THE HEARING
Following the scandalous incident reported by 12punto yesterday, Future Party Chairman Ahmet Davutoğlu came to the courtroom today with his wife, Sare Davutoğlu, who is a doctor. Davutoğlu and his wife, who watched the court from among the audience for a while, later left the hall.
13.26
'Fırat Sarı KNEW'
Fırat Sarı's Lawyer: There is a tape conversation about Deniz Korkmaz, who is said to have a company established in his name. You said, "I hired Deniz as an intelligence officer." What do you mean by this?
Defendant Hasan Basri Gök: I remember the conversation, but I didn't say this. This is Hakan Doğukan Taşçı's statement.
Fırat Sarı's Lawyer: You say that Mr. Şehmus knew about Doğukan introducing himself as a doctor. Well, did Fırat Sarı know?
Defendant Hasan Basri Gök: He did.
Fırat Sarı's Lawyer: How many boxes of medicine did you sell?
Defendant Hasan Basri Gök: We sold 40 or 50.
Fırat Sarı's Lawyer: How many of them did Fırat Sarı know about?
Defendant Hasan Basri Gök: I don't know how many boxes we sold secretly from him.
Fırat Sarı's Lawyer: If you sold 50 boxes in total, how many could Fırat Sarı have taken?
Defendant Hasan Basri Gök: I don't know.
13.32
Sümeyye Nur Arslan's lawyer: You said, "Sümeyye was Fırat Hodja's advisor." How can a nurse assistant be an advisor?
Hasan Basri Gök: Sümeyye is not a nurse assistant, she is a nurse. I said that because all the accounting work belonged to Sümeyye.
OBJECTION FROM THE MINISTRY OF HEALTH LAWYER TO THE 112 QUESTION
The question of whether 112 had a hand in this business was asked.
The Ministry of Health representative objected to the question being asked.
Ministry of Health Lawyer Alanur Öztürk: It is not possible for such a thing to happen.
The presiding judge accepted the objection to the question.
13.51
A 30-minute break was given to the hearing.
The break is over. The presiding judge took his place, the defendants are being brought in. Fırat Sarı is constantly communicating heatedly with the other defendants next to him.
After Hasan Basri Gök, the detained defendant Deniz Korkmaz took the stand.
Presiding Judge: You are accused of fraud against public institutions and organizations, and membership in crime and criminal organizations.
Will you make a defense?
Defendant Deniz Korkmaz: I have been working at the hospital for 7 years. I worked in the baby intensive care unit as a nurse.
"I WAS THE FIRST TO COMPLAIN TO CIMER"
Presiding Judge: What is your defense?
Defendant Deniz Korkmaz: I did not see any concrete evidence regarding the accusations made against me. The funny part is that I was the first to complain about this incident to CIMER (Presidential Communication Center), but I was arrested.
"IT IS A LINE FROM KURTLAR VADISI"
The presiding judge asked about his conversation with Hasan Basri Gök.
Defendant Deniz Korkmaz: Robbing the state is more honorable than robbing the nation. There is a line in Kurtlar Vadisi (Valley of the Wolves). I used it for that reason.
The presiding judge is asking questions from the indictment, detained Deniz Korkmaz is answering, but the conversations are not clearly understood.
Presiding Judge: You said that Fırat Sarı receives commissions at rates like 30-40 percent in the system he established, is that true?
Defendant Deniz Korkmaz: It is true.
Presiding Judge: What is the GMZ company?
It is the company Fırat Sarı had established in my name. He said, "You will also be a company owner," and unfortunately, I accepted.
Presiding Judge: On what?
Defendant: I know it is on Health and Tourism.
Presiding Judge: Who managed the company's money movements?
Defendant Deniz Korkmaz: Sümeyye Nur Arslan.
"THEY SAW THE PATIENT AS A PURCHASED ITEM"
Defendant Deniz Korkmaz: At Reyap hospital, 1 nurse was made to look after 5 patients. It was inevitable that these things would happen in a hospital that saw the patient as a purchased item.
Presiding Judge: Do you know İlker Gönen?
Defendant Deniz Korkmaz: When there was a problem in the hospitals where Fırat Sarı was a consultant, he would come when they called, like TRG, thank you.
"HE WAS LOCKING UP INTENSIVE CARE MATERIALS"
Defendant Deniz Korkmaz: He is a man who even locks up the materials in intensive care. (I couldn't hear who the man was)
He is someone who says nurses should use less so it's less expensive. He locks up the materials. There can be nothing more despicable than locking up materials in intensive care. Materials are used for the patient's well-being.
"I COMPLAINED, I AM NOT REGRETFUL"
Presiding Judge: Is there anything you would like to add?
Deniz Korkmaz: The reason I made these complaints is that they see people as money. I am never regretful, and there is no situation where I intended to harm anyone's life. There is no such accusation directed at me anyway.
Cross-examination began.
Lawyer: Why did you allow the company to be in your name, you are an educated person.
Defendant Deniz Korkmaz: I didn't know it was something this big.
I had a dream of establishing a company myself. But I didn't know. I was uncomfortable. I said, "Take this company from me." And he was arrested that day, today.
"WHAT ARE PIPE AND TRAIN"
Lawyer: You have profanity-laden conversations like "the pipe and train that will enter us," what are the train and pipe there?
Defendant Deniz Korkmaz: If I had such a fear, I wouldn't have started this case. I was the one who brought this to light.
QUESTIONS IN COURT: "WHY IS YOUR NAME DENIZ, DID YOU LIKE IBRAHIM KAYPAKKAYA"
İlker Gönen's lawyer: May I learn why your name is Deniz, is there a special reason?
Defendant's lawyer: We have an objection to this question.
Did you like İbrahim Kaypakkaya, do you have a connection with a leftist organization?
İlker Gönen's lawyer: Does he have a criminal record regarding the law on demonstrations and marches? Has he ever been to the Vatan police headquarters?
The question was objected to.
İlker Gönen's lawyer: Does your CIMER complaint match the concept of "my dear state"?
Defendant Deniz Korkmaz: Is this a bad thing?
"SHOULD WE EAT STONES?"
Lawyer: Why did you apply for a job at the hospital you named?
Defendant Deniz Korkmaz: What should we do, should we eat stones?
Fırat Sarı'S TRIAL FOR MEMBERSHIP IN A TERRORIST ORGANIZATION
Fırat Sarı's lawyer: Where did he learn that Fırat Sarı was being tried for a terrorist organization, why did he put this in the CIMER complaint?
Deniz Korkmaz: The complaints I made were not attracting attention, so I added it. I thought it would attract attention this way. I also think I was successful.
Defendant Hüseyin Günerhan was brought in.
Günerhan claimed that his statements in the second testimony he gave at the prosecutor's office were changed and rejected his prosecutor's testimony.
Presiding Judge: What is your defense?
Hüseyin Günerhan: I do not believe that such an organization exists. There is no such organization. There is an absolute monarchy in the health system. We are all connected to the doctors who are the heads of the units, there is no organization here.
Presiding Judge: Where did you work?
Hüseyin Günerhan: I am a nurse. I am the nurse you can think of in a hospital. I worked everywhere from where human life takes its first step to where it ends.
CRIMINAL COMPLAINT AGAINST DENIZ KORKMAZ FROM Fırat Sarı'S LAWYER
Fırat Sarı's lawyer: It is forbidden to spread this information according to the law on reintegration into society. He also presented this information to your knowledge just now. We are filing a criminal complaint because he spread this information, let's state that too.
Deniz Korkmaz's lawyer: My client is someone who doesn't even know how to issue an invoice. There is no issue he has disclosed to the public. It is a statement put into CIMER. If it has become public later, we don't have a situation regarding that. If my client hadn't complained, there wouldn't be such a case. He is the person who collapsed this organization anyway. As can be understood from the tapes, he is not liked either. They say let's talk when Deniz is not around. Considering the detention period, we request his release.
Presiding Judge: Do you have any information about Kaya baby?
I have no information. Doğukan had called around 3 at night, other than that the baby's condition was bad, I have no information.
Presiding Judge: There is also the issue of giving money...
Defendant: I am also accused by the hospital of defrauding the SGK. If I caused damage to the SGK, the hospital should make a profit, if the hospital suffered damage, the SGK should make a profit, there is a contradiction here.
The presiding judge asked Hüseyin Günerhan for his final words.
Hüseyin Günerhan: I looked after patients I saw more than my mother and father in my life. While the others were lying in Silivri, I stayed in Metris prison for 3 months. I stayed in the murder ward. We were already announced as baby killers. My ward was changed by saying pardon to me. What would have happened if something had happened to me? If there are people to be blamed here, let them say pardon and let it be passed over. I do not accept the accusations against me.
Hüseyin Günerhan: I work at Güney hospital, how can I know the events at Reyap hospital, it is asked here as if we were witnesses like this
Presiding Judge: What happens here is being recorded, that's why. There can be no conversation like I reject it later.
Cross-examination began.
Member judge: How do you explain the money exchange with Hakan Doğukan.
Hüseyin Günerhan: We were roommates with Hakan Doğukan. It goes back to 2014. We had borrowed and lent money from each other.
"I SAID OUR MOTHERS WILL CRY"
Prosecutor: In your conversation with Doğukan, he makes an organization accusation and you confirm it.
Defendant: 'Fırat Sarı has membership from the PKK. Maybe he connected the money here to the organization. They might stick us from there, our mothers will cry,' I say.
Prosecutor: What is the reason for leaving Güney hospital? Did Fırat Sarı request it, or did you leave yourself?
Defendant: I left myself.
Prosecutor: There is a conversation of yours with Doğukan in the tapes. A baby has died. Doğukan says to you, 'They showed it as the first.' You say, 'God, god, did they show it as the first, I had changed it,' what is this?
Defendant: While making the death notification, we must have made it the first hospital instead of Güney hospital.
Prosecutor: Do you remember which baby this is?
Defendant: I don't remember.
Lawyer: If a child were a patient, which hospital would you want to take them to?
Presiding Judge: It was a question like an advertisement, it cannot be accepted.
Lawyer: I didn't think it had an effect because the hospitals were closed.
The prosecutor came.
Defendant Hüseyin Gündüz: I know Hakan Doğukan Taşçı from the people whose names are mentioned in the files. I bought crime from Doğukan. But I don't know that these are crimes. I have been in custody for 7 months.
Presiding Judge: Who do you know besides Hakan Doğukan
Defendant Hüseyin Gündüz: Volkan Hodja, it should be Çağla, and also Ceylan
Presiding Judge: How many times did you buy medicine?
Defendant Hüseyin Gündüz: I bought it 3-4 times in total
Presiding Judge: How much did you sell it for?
Defendant Hüseyin Gündüz: I bought it for 600 TL and sold it for 1000 TL.
Presiding Judge: Who did you sell it to?
Defendant Hüseyin Gündüz: I sold it to someone named Reşat over the internet. It is stated in the prosecutor's office that I have a statement that the medicines went abroad. But I have no such statement.
Presiding Judge: You said you sold it to an Azerbaijani person, is that true?
Defendant Hüseyin Gündüz: True. He was sending a courier. He was giving cash. In the last one, the courier took it and ran away, and he blocked me from everywhere anyway, thank you.
Presiding Judge: How much did you earn?
Defendant Hüseyin Gündüz: I must have earned 24 thousand TL.
Presiding Judge: You are accused of knowingly and willingly helping the organization, and fraud through public and institutions.
Hüseyin Gündüz: I do not accept the accusations against me in the file.
Gündüz's lawyer stopped the interrogation because the prosecutor was not in his place.
The prosecutor is expected to come.
After defendant Hüseyin Günerhan, defendant Hüseyin Gündüz was brought in.
"HE WAS PRODUCING EYE DROPS AND SELLING THEM TO PHARMACIES"
Lawyer: Didn't you ask Hakan Doğukan Taşçı where the medicines came from?
Hüseyin Gündüz: Hakan Doğukan Taşçı produced eye drops and sold them to pharmacies. I didn't ask where they came from. I thought he obtained them from the representative.
Hüseyin Gündüz's lawyer:
"I have read the 1400-page indictment at least 3 times. Every time I asked what Hüseyin Gündüz is doing in this file. Did he make a promise to someone? The indictment is so far from seriousness in terms of my client. My client also has no action regarding medicines against the SGK."
Defendant lawyers made a request to the presiding judge, "When it drags on after 8, we cannot meet with our clients. If we can finish one day early, let us also meet with our clients."
A 15-minute break was given.
After defendant Hüseyin Gündüz, Fehmi Alperen was brought in.
Fehmi Alperen: I have not had any work in the newborn field. The defects that are the subject of the accusation were not carried out by me.
Presiding Judge: Where do you work?
Fehmi Alperen: I am an ambulance driver. I have been working within the IBB (Istanbul Metropolitan Municipality) for 17 years. I also have a consulting company.
The presiding judge asked about a tape.
Fehmi Alperen: I only told Gıyasettin Mert that a patient had been waiting for 4 hours. He also asked Güney hospital. Güney hospital also accepted.
Presiding Judge: Did you have any benefit from this?
Fehmi Alperen: No, I don't know the family. I said it to help.
Presiding Judge: You said that Hakan Doğukan Taşçı committed SGK fraud by discharging babies that should have been discharged without discharging them.
Fehmi Alperen: He is the one who told me these issues. When I left Birinci Hospital, he told me, and I told the prosecutor.
Presiding Judge: How much does Gıyasettin Mert get?
Defendant: It is not possible for me to get what Gıyasettin Mert gets. I know what I did with my own company. I issued its invoice and paid my tax to the state.
Presiding Judge: Which hospitals did you work with.
Defendant: I did it at Avcılar Medicana, Birinci hospital. I have been in prison for 7 months.
Presiding Judge: You normally work at 112, right?
Defendant: Not 112, but I am in the emergency unit of the metropolitan municipality.
Presiding Judge: What is your status?
Defendant: Worker
Presiding Judge: Are you a driver?
Defendant: Yes.
Presiding Judge: How does it happen with you?
Defendant: It comes from 112, but newborn doesn't come.
"WHY ARE YOU SWITCHING TO WHATSAPP?"
Cross-examination began.
Prosecutor: In general, you do not accept the accusations. There is a meeting you had on November 4, there is a meeting with a turnover of 1 million. You say, 'Let me switch to WhatsApp.' Why do you feel the need to switch to WhatsApp?
Defendant: I sent a medicine image from the WhatsApp conversation. That's why.
"THE PERSON I CALL BOSS IS HOSPITAL OWNER ALI AKSOY"
Lawyer: Why did your interest relationship with Fırat Sarı break down?
Defendant's lawyer: There is guidance, we object to the question. He is talking about interest. He is speaking accusingly...
Presiding Judge: It was decided that the question could be asked.
Defendant: When I learned about these events and told the hospital owner, he said things for me to be eliminated. There is not a single lira that came to my own account, including Fırat Sarı's personal account.
Lawyer: Were you referring patients to Bağcılar Medilife hospital?
Defendant: I was not.
Lawyer: Who is the person you call boss?
Defendant: Hospital owner
Lawyer: Who is the hospital owner
Defendant: Ali Aksoy.
Fehmi Alperen's lawyer:
My client suggested a hospital suitable for the patient. It is a mistake to portray his legal trade as a crime. We do not agree with the organization accusation. We request his release.
Fehmi Alperen's other lawyer:
There is no hierarchical structure in which my client has an organic relationship, he does not receive instructions from anyone, there is no question of him obeying or giving orders. He is not in any part of these accusations.
Today's Newborn Gang hearing has also ended. The presiding judge said that tomorrow's hearing will start at 9.30. 5 defendants today and 6 in total were heard.
