Berkin Elvan verdict upheld: 16 years and 8 months in prison for his killer

14-year-old Berkin Elvan was shot in the head with a tear gas canister by police officer Fatih Dalgalı on June 16, 2013, during the Gezi Park protests. Elvan passed away on March 11, 2014, after remaining in a coma for months. Following a long trial, police officer Fatih Dalgalı was sentenced to 16 years and 8 months in prison for "killing a child with probable intent."

FIRST CRIME SCENE INVESTIGATION CONDUCTED 6 YEARS LATER

The first crime scene investigation at the location where Berkin Elvan was shot was conducted on April 10, 2019. The report, which included measurements from the Elvan family's home in Okmeydanı to the spot where the police officer fired, and assessed whether it was possible for the officer to have shot Elvan, was submitted to the court on June 18, 2019.

While the investigation into Elvan's death was completed after 1,270 days, the case was opened with an indictment prepared on December 20, 2016.

Following a long trial, police officer Fatih Dalgalı was sentenced to 16 years and 8 months in prison for "killing a child with probable intent." The sentence was also upheld two years ago by the 1st Criminal Chamber of the Istanbul Regional Court of Justice.

DALGALI IS FREE, ELVAN'S LAWYERS ARE IN PRISON

The police officer who took Berkin Elvan's life has not spent a single day in prison to date. Following the upholding of Fatih Dalgalı's sentence by the Court of Cassation, his imprisonment is now expected.

While the killer police officer has not spent a single day in prison, Oya Aslan, one of the lawyers for the Elvan family, and Can Atalay, who remains unlawfully imprisoned despite being elected as a Member of Parliament from Hatay due to the sentence handed down in the Gezi Park trial and despite Constitutional Court (AYM) rulings, are still being held in prison.

Oya Aslan, one of the lawyers on the case, has also been held in prison since 2019.
