The court has reached a decision in the cancellation lawsuit filed regarding the 21st Extraordinary Convention, which was planned to be held on April 6, 2025, by the decision of Republican People's Party (CHP) Chairman Özgür Özel. The application made by former Hatay Metropolitan Municipality Mayor Lütfü Savaş and the lawyer for the convention delegates, Onur Yusuf Üregen, was evaluated by the Ankara 31st Civil Court of First Instance.
COURT ISSUES REJECTION
The court rejected the request for an interim injunction to cancel the convention. The interim decision emphasized that an interim injunction can only be granted regarding the subject of a dispute, but that the activities of a legal entity cannot be evaluated within this scope. Furthermore, it was stated that an interim injunction cannot be applied in a lawsuit regarding the cancellation of a general assembly and that the activities of a legal entity can only be subject to a lawsuit after they have taken place.
''LAWSUIT CAN BE FILED AFTER THE CONVENTION''
The court stated that a decision regarding whether the extraordinary convention that the CHP will hold on April 6, 2025, is unlawful can only be brought to the judiciary after the convention has been completed. The decision stated that the request for an interim injunction was rejected on the grounds that the documents submitted by the plaintiff did not comply with the rules of prima facie evidence and that the allegations were not supported by sufficient evidence.
