Chaos in the courtroom during the Ayhan Bora Kaplan criminal organization trial! He called the police 'FETÖ members'

The retrial of the Bora Kaplan criminal organization case, in which the number of defendants reached 75 following the merger of 3 files after the appellate court's reversal decision, has begun.

The most striking detail of the case is that Bora Kaplan and the police officers who conducted the operation against him will be tried together.

While 4 of the police officers, who are both defendants and complainants, took their places in the courtroom, 2 connected via SEGBİS.

In the hearing, where intense security measures were taken, the court panel was expected to take its place and the detained defendants Bora Kaplan and the secret witness codenamed M7, Serdar Sertçelik, were expected to be brought into the courtroom.

Bora Kaplan, who was brought into the courtroom at 10:56, waved to the non-detained defendants and the lawyers.

The panel took its place at 11:00.

Finally, at 11:03, Serdar Sertçelik was also brought into the courtroom, and the hearing began with the identification of the defendants.

The Presiding Judge, who first read Serdar Sertçelik's name, said upon seeing Sertçelik, "Is that you? Did you cut your beard?"

The first issue addressed in the hearing was the police officers' request for separation of the case.

The prosecutor requested that the request be rejected on the grounds that the appellate court's reversal decision and some evidence and facts should be evaluated together. The court decided to reject it.

Many defense lawyers stated that they could not access the approximately 100 folders of the two merged cases and that the decision not to provide the digital materials that form the basis of the case eliminated the possibility of defense, and they requested that these be provided and that they be given time.

BORA KAPLAN CALLED THE POLICE 'FETÖ MEMBERS'

When Bora Kaplan called the police “FETÖ members,” the courtroom erupted in chaos, and insults were exchanged. As Kaplan was being removed from the courtroom, he called the police “FETÖ members” once again.

Police chiefs Murat Çelik and Şevket Demircan reacted by saying, "You rude person, who are you? We saw who sent the message to Cevheri about being a FETÖ member."

The tension also spread to the audience. Relatives of the defendants reported that the relatives of the police officers were insulting them. The Presiding Judge had those who claimed they were being insulted removed from the courtroom.

The prosecutor submitted an opinion for the rejection of the defense lawyers' request to adjourn the hearing. The court then took a break to decide on this matter.

After a 15-minute break, the court decided to reject the requests for time.

Bora Kaplan's lawyer, Rıdvan Şahin, requested that Bora Kaplan, Muhammet Kaplan, and İzzet Savaş, who were removed from the hearing after the tension, be brought back into the courtroom.

The Presiding Judge allowed the three defendants to be brought back, saying, "I will give you one last chance. Let this not happen again. We have already evaluated these issues; if you ask for the floor again, I will not grant it."

When the defendants arrived, the Presiding Judge repeated his words and said, "If it happens again, I will throw you out." Bora Kaplan asked for the floor anyway. After the Presiding Judge replied, "Bora Kaplan, you will make your statement when your turn comes, okay?" the taking of defenses began with Serdar Sertçelik.

Serdar Sertçelik's first words were, "We have seen a lot of injustice during this investigation process. My only request from you is that you conduct a fair trial."

The Presiding Judge replied, "Have no doubt."

Serdar Sertçelik repeated his statements after coming to Turkey and accused the police.

Sertçelik alleged that the police ate cake after forcing him to accept being a secret witness, and that they gave him a slice of cake and tea as well.

Serdar Sertçelik explained that Deputy Police Chief Murat Çelik accused the then-KOM Branch Manager Kerem Gökay Öner, but that he had never seen Öner and only heard his name after going abroad.

Sertçelik said, "I believe that sooner or later, one of them will say that Murat Çelik made them do these things."

Sertçelik emphasized that when the police asked him to also name Süleyman Soylu, Sadık Soylu, Bekir Bozdağ, Abdulhamit Gül, and Fahrettin Koca, as well as Presidential Chief of Staff Hasan Doğan, he saw how reckless they were and realized that their goals were very different.

When Serdar Sertçelik reminded the court that even before he came from the TRNC and became a secret witness, the police had correspondence showing they were monitoring the financial transactions of former Ankara Chief Public Prosecutor Yüksel Kocaman and the nephew of Halkbank General Manager Osman Aslan, Bilal Aslan, the Presiding Judge said, "You are saying that they made you say these things by doing preliminary preparation." Sertçelik replied, "Of course. These are my two pillars of support."

Sertçelik said that it was revealed in the police's correspondence that they were also investigating the former MHP Etimesgut Mayor Enver Demirel.

Upon Serdar Sertçelik reading his written defense, the Presiding Judge said, "You are both reading and talking." When Sertçelik replied, "I have been waiting for this day for 3 years," the Presiding Judge said, "Then you should have come earlier, Serdar," and adjourned the hearing for 45 minutes.

Continuing his defense in the afternoon session of the hearing, Sertçelik explained that in their conversations, Şevket Demircan asked about former Chief Prosecutor Kocaman and Deputy Chief Prosecutor Ahmet Yıkılmaz, "Is there anything against them?" to which the Presiding Judge warned, "Do not state the content."
