CHP's application decided by the Constitutional Court: Cancellation ruling issued for emblem

The decision of the Constitutional Court (AYM) regarding the application filed by the Republican People's Party (CHP) requesting that the name and emblem of the Republican Nation Party (CMP) be declared invalid and removed from the political party registry has been published in the Official Gazette.

In its application, the CHP stated that the name "Republican Nation Party" resembles its own name both phonetically and in terms of meaning, and that the arrow symbol used in the party's emblem is of a nature that could be confused with the CHP by voters. The application requested that the party name and emblem be declared invalid and removed from the political party registry.

The Office of the Supreme Court Chief Public Prosecutor, in its opinion submitted to the court, stated that the terms "republican" and "nation" cannot be exclusive to any single political party, and that the arrow symbol has been used by various political parties in Turkish political life for many years, thereby recommending that the application be rejected.

REQUEST REGARDING PARTY NAME NOT ACCEPTED

In its assessment, the Constitutional Court concluded that the name "Republican Nation Party" does not bear a level of similarity that would cause confusion with the CHP.

The decision stated that it is possible for the words "Republican" and "Nation" to be used by more than one political party, and that these expressions cannot be considered exclusive to a specific political party.

In line with these justifications, the court unanimously rejected the request for the name of the Republican Nation Party to be declared invalid and removed from the political party registry.

DIFFERENT ASSESSMENT FOR EMBLEM

In its examination regarding the emblem, the court decided that the symbol used by the Republican Nation Party is similar to the CHP's emblem to an extent that could lead to confusion.

For this reason, the Constitutional Court ruled by majority vote that the emblem of the Republican Nation Party be declared invalid and removed from the political party registry. Members Engin Yıldırım, Muhterem İnce, and Ömer Çınar cast dissenting votes.

JUSTIFICATION FOR DISSENTING VOTE

In the dissenting opinion, it was argued that there is no similarity between the emblems of the two political parties that would cause confusion among voters. The justification stated that the emblems are distinguishable from each other in terms of shape, color, lettering, and general design elements.
