Court cancels speeding ticket issued on the way to the hospital
In Antalya, a 6,439 Turkish Lira radar fine issued to a driver who was speeding to rush an injured colleague to the hospital has been canceled by a court decision. It was stated that Süleyman K., who works at a yacht company in the Konyaaltı district, needed to be taken to the hospital urgently after his finger was caught in a machine. Evaluating the objection filed by the company's lawyer, the court ruled to cancel the fine, stating that the speed violation was committed due to an emergency and did not endanger traffic safety.

Süleyman K., an employee at a yacht company in the Antalya Free Zone in the Konyaaltı district of Antalya, was injured when his finger was caught in a machine during his shift. Following the incident, the company vehicle driven by his colleague, who was trying to rush Süleyman K. to the hospital, was caught by a radar on the road. A traffic fine of 6,439 Turkish Lira was issued to the company vehicle by a Traffic Inspection Branch team on the grounds that the speed limit was exceeded by more than 50 percent.
Upon notification of the fine, an application was made to the Antalya 3rd Criminal Court of Peace through the company's lawyer, requesting the removal of the administrative sanction.
HOSPITAL DOCUMENTS ADDED TO THE OBJECTION PETITION
The application petition emphasized that the speed in question was not intentional, and that the speed limit had to be violated because the employee was injured in a workplace accident and was being rushed to the hospital in an emergency. Hospital documents proving the worker's injury were also added to the objection petition.
Evaluating the objection, the court ruled to cancel the administrative sanction on the grounds that the driver was trying to rush the injured Süleyman K. to the hospital, did not endanger traffic safety, and was acting within the scope of right-of-way priority.
Company lawyer Mustafa Alper Oral stated that the employee working for the client company cut his finger while using a saw, and that they set off to take him to the hospital by company vehicle due to the urgency of the situation.
Stating that the radar fine was issued while the injured person was being taken to the Akdeniz University Faculty of Medicine Hospital, Oral said the following:
"We examined the fine report and learned that this radar fine was issued at the time the worker was being rushed to the hospital. We applied to the court with documents revealing the urgency of the situation and that the injured person was receiving treatment at the hospital. The court ruled that the driver was in such distress that he could not even consider the weight of the worker, that he prioritized the right to life, and that he prioritized the right-of-way. Due to this situation, it decided that the radar fine should not be applied. The 6,439 Turkish Lira traffic fine has been canceled. This is a final decision and sets a precedent. The decision shows that if such a situation occurs anywhere in Turkey, the radar fine will not be applied, and the necessary objections must be made."
On the other hand, Oral stated that thanks to the employee being rushed to the hospital in time, his finger was reattached and his treatment is continuing.
