Court has ruled: Adnan Polat has lost the case!

Citizens living in the Levent neighborhood of Istanbul's Beşiktaş district have won their second legal victory against Adnan Polat and the Beşiktaş Municipality. The court had previously issued a stay of execution in the lawsuit filed by 73 citizens fighting against "zoning rent." Following this development, the appeal filed by the Beşiktaş Municipality and Adnan Polat's company was also rejected.

The construction permit for the project, which drew reactions from citizens, was issued by the Beşiktaş Municipality on December 29, 2022. Construction of a luxury residential project was started by the company of Galatasaray Sports Club's former President Adnan Polat on a plot of land belonging to Rönesans Fuarcılık Company.

The citizens, who filed a lawsuit at the Istanbul Administrative Court, had requested the cancellation of the construction permit. The citizens emphasized that the construction project remained within the boundaries of the Bosphorus Conservation Area Impact Zone and was contrary to the zoning plan. It was stated that the project, which was claimed to be in violation of the Bosphorus Law and regulations, would consist of 9 basement floors, a ground floor, and 14 regular floors.

Emphasizing that "a special zoning privilege was granted to the company," the citizens stated in their petition, "Since the non-party company has started construction with the building permit requested to be cancelled and continues its activities, it is clear that this will cause irreparable damage to the plaintiffs. In fact, this damage has already manifested itself; the non-party parcel owner has already occupied part of Altzeren Street and Ülgen Street, and the parking bays used by the plaintiffs and local residents have become unusable due to this occupation. Even at the time this petition was written, the parcel owner continues to occupy the street, exceeding the parcel boundaries and erecting particleboard walls."

Furthermore, the citizens underlined in their petition that the project would cause irreparable damage. While the Beşiktaş Municipality requested the dismissal of the case, the court reached a decision on April 24. In its ruling, the court emphasized that the transactions subject to the lawsuit were unlawful and issued a stay of execution.

Subsequently, the Beşiktaş Municipality and Adnan Polat's company appealed the stay of execution decision. On May 23, the Istanbul Regional Administrative Court unanimously decided to reject the appeal.
