Criminal complaint filed with the prosecutor's office… How did the Company Commander change his opinion regarding the lieutenants?!

During the process of dismissing lieutenants who graduated from the Military Academy from the Turkish Armed Forces (TSK), the changing statements of a company commander and allegations of irregularities in the file have been brought to the judiciary. In the criminal complaint filed with the prosecutor's office, it was requested that witness statements be taken to clarify allegations of pressure and that those responsible be punished.

A flash development has occurred regarding the lieutenants whose dismissal from the TSK was requested for crossing their swords and reciting the "Officer's Oath" after the Military Academy graduation ceremony, where they declared, "We are the soldiers of Mustafa Kemal." A criminal complaint was filed with the Ankara Chief Public Prosecutor's Office, alleging that a company commander at the Polatlı Artillery and Missile School had stated in front of the entire company, "I will not express an opinion in favor of the dismissal of the lieutenants," but later changed his opinion, and requesting that this company commander and those who forced him to change his opinion be identified and punished.

In the criminal complaint filed today by Namık Öztürk, one of the lawyers for the lieutenants facing dismissal, it was recalled that some documents were removed from the investigation file provided to them, and that on November 29, the Personnel Department of the Land Forces Command returned the "Disciplinary Supervisors' Opinion and Proposal Form" prepared for Lieutenants Deniz Demirtaş, Ebru Eroğlu, and Serhat Gündar on the grounds that the opinion and proposal section was not filled out in accordance with the regulations, and that it was later announced on December 3 that the specified deficiencies had been resolved. The complaint stated, "It is understood that the document regarding which opinion and proposal the lieutenants' supervisors initially provided is not in the file sent later, and that the file contains the opinions and proposals that these supervisors re-prepared."

The following striking information was also included:

"This fact must be evaluated in light of an event that took place before the High Disciplinary Board (YDK) files were first sent to the Land Forces Command. Specifically; during the creation of the YDK file regarding our clients who are continuing their training at the Polatlı Artillery and Missile School Command, the company commander who was to prepare the opinion and proposal made a speech to the company during a formation attended by all lieutenants training at the Artillery School at that time, and announced that he would not express an opinion in favor of imposing a dismissal penalty from the Armed Forces regarding the lieutenants for whom the YDK file was being prepared. In fact, the return of the YDK file after it went to the Land Forces Command due to irregularities in the opinions and proposals shows that the aforementioned company commander acted in the direction he stated during the company formation, but was later forced to change this opinion somehow. All lieutenants who were trainees in the company are witnesses to the speech the company commander made to the company during the formation."

In the criminal complaint, it was requested that the list of names of all lieutenants who were trainees in the company be obtained, that both they and the company commander who made this speech be questioned, and that the material truth be revealed.

Furthermore, it was requested that the individuals who forced the aforementioned supervisors to make an opinion and proposal other than their initial ones be identified and punished at the upper limit in accordance with the Military Penal Code, the Turkish Penal Code (TCK), and other crimes to be determined by the Public Prosecutor's Office.
