In the investigation into the Selim Köse Apartment, which became a grave for 42 people, including 14 children, during the February 6 earthquakes centered in Kahramanmaraş, it has emerged that the suspect, who was placed under judicial control, was never notified of the decision and did not even sign in for months.

During the February 6 earthquakes that occurred in Kahramanmaraş, the Selim Köse Apartment in the Odabaşı neighborhood of Hatay's Antakya district was also leveled.
JUDICIAL CONTROL DECISION ISSUED
According to a report by İsmail Arı from BirGün; a total of 42 people, 14 of whom were children, lost their lives in the collapsed apartment building. As part of the ongoing investigation, the Hatay 2nd Criminal Judgeship of Peace issued a judicial control decision on March 23, 2023, for a suspect named Eysem E., requiring her to sign in once a week and imposing a travel ban.
COURT REJECTED THE REQUEST!
However, a document prepared by the court on December 7, 2023, revealed that the decision had not been served to Eysem E., and therefore she had not signed in on the designated days, meaning the judicial control was never implemented.
The reason cited was that the PTT (Turkish Post) organization was not operating when the decision was made.
Lawyer Seda Mutaf, who lost relatives in the collapsed apartment, requested the arrest of Eysem E. on December 6, 2023, for failing to comply with the judicial control decision. However, the court rejected this request as well.
A CHAIN OF SCANDALS
Lawyer Seda Mutaf filed a complaint with the Council of Judges and Prosecutors (HSK) against the judge of the Hatay 1st Civil Court of Peace.
Mutaf noted that while she was awaiting a response to her request for core and iron samples to be taken from the wreckage and for drilling to be conducted at the site, the requests of the suspect Eysem E. were rapidly accepted. In her complaint, Mutaf stated the following:
"BY DISREGARDING LEGAL PRINCIPLES..."
“While two separate miscellaneous case files containing evidence detection requests were pending at the Hatay 1st Civil Court of Peace, and while we were awaiting a response to our request for core and iron samples and drilling, we learned that there was an evidence detection request filed by the investigation suspect Eysem E. Furthermore, the fact that core samples were taken in a newly opened evidence detection case while two other miscellaneous case files were already awaiting evidence detection is a very important issue that clearly shows the court has lost its impartiality. As a result of decisions that disregard legal principles, are contrary to equality, and cast a shadow over the judge's impartiality, it has become necessary to file a complaint with your Presidency on behalf of my clients in order to ensure that the necessary investigation into the judge is conducted.”
"THEY ARE NOT BEING HELD ACCOUNTABLE BEFORE THE JUDICIARY"
Asking, “Why are our requests rejected while the suspect's requests are accepted?”, Lawyer Seda Mutaf stated to BirGün, “In response to our requests, they say ‘The Prosecutor's Office has already taken iron and core samples,’ but they take these samples whenever the suspect wants. All the suspects in the file are walking around freely. They are all relatives, and some are even continuing to engage in construction. They essentially prepared a grave for us, but they are not being held accountable before the judiciary.”
