'Mobilization and State of War Regulation' published in the Official Gazette with Erdoğan's signature

According to the regulation published in the Official Gazette with Erdoğan's signature, the 24-year-old 'Mobilization and State of War Statute' has been abolished. In its place, the 'Mobilization and State of War Regulation' has been published.

AKP Chairman and President Tayyip Erdoğan has abolished the 'Mobilization and State of War Statute' published on May 24, 1990.

According to the regulation included in the Official Gazette with Erdoğan's signature, the 'Mobilization and State of War Regulation' has been put into effect.

The following statements were included in decision number 8510:

“It has been decided to abolish the ‘Mobilization and State of War Statute’ put into effect by the Council of Ministers Decision dated 24/5/1990 and numbered 90/500, and to put into effect the attached ‘Mobilization and State of War Regulation’, in accordance with Article 19 of the Mobilization and State of War Law No. 2941 dated 4/11/1983 and Article 57 of the Recruitment Law No. 7179 dated 25/6/2019.”

ORGANIZATIONAL DUTIES OF THE MINISTRY OF NATIONAL DEFENSE, GENERAL STAFF, AND FORCE COMMANDS

In the fifth paragraph of the fifth article, which regulates the "Organization" heading under the second section titled "Organization, Duties, Authorities, and Responsibilities" of the new regulation that has come into effect, the assignments between the Ministry of National Defense, the General Staff, and the force commands were stated as follows:

5th paragraph:

“The cadre and organization related to mobilization procedures in the Turkish Armed Forces are determined by the General Staff and approved by the Ministry of National Defense. The coordination, control, and inspection services regarding the mobilization and state of war preparations of the Turkish Armed Forces are carried out separately by the Ministry of National Defense, the General Staff, and the force commands for their own affiliates and units under their command.

6th paragraph:

“The Ministry of National Defense makes the necessary arrangements according to the principles of this Regulation in order to carry out the duties and services regarding mobilization and state of war preparations in harmony with its affiliated, related, and associated organizations according to their areas of responsibility and expertise.”

COORDINATION DUTY

The sixth article of the regulation describes the "Coordination duty".

The article included the following statements:

“(1) In the execution and implementation of mobilization and state of war preparations at the highest level;

a) The Ministry of National Defense;

1) In transactions related to the Turkish Armed Forces;

2) In transactions related to the Gendarmerie General Command and Coast Guard Command units that will come under the command of force commanders with the President's decision in cases of mobilization and war,

b) The Secretariat General of the National Security Council; in transactions outside the scope of duty of the Turkish Armed Forces,

c) The Presidency; in the joint execution of the transactions specified in the (a) clauses,

carries out the coordination duty.”

DUTIES AND AUTHORITIES OF THE PRESIDENCY

The seventh article of the regulation bears the title "Duties and authorities of the Presidency".

The article included the following statements:

“(1) The duties and authorities of the Presidency are as follows:

a) To ensure that all work is carried out in a coordinated manner during mobilization and state of war preparations and during mobilization and state of war.

b) To perform the duties assigned by legislation.

c) To perform other duties assigned by the President.”
