Execution regulation published in the Official Gazette and entered into force

The execution regulation, published in the duplicate issue of the Official Gazette with the signature of AKP Chairman and President Erdoğan, has entered into force.

The 10th Judicial Package, which includes the execution regulation that paves the way for the release of more than 19,000 inmates, was published in the Official Gazette and entered into force after being accepted by the General Assembly of the Parliament with 8 articles removed.

PATH TO RELEASE OPENED FOR THOUSANDS

With the law, individuals who have received multiple sentences for committing more than one crime will also benefit from the opportunity for conditional release.

Thus, the path to release will be opened for 19,800 people.

It may be decided that the sentences of inmates who cannot sustain their lives in penal institution conditions due to illness or disability and who are "assessed as not posing a serious and concrete danger to public safety" be served at their residence.

However, individuals sentenced to aggravated life imprisonment will not be able to benefit from this right.

It may also be decided by the execution judge that women who have passed 6 months since giving birth and who have received a prison sentence of 5 years or less may serve their sentence at their residence.

The right to serve a sentence at home will be from 1 to 3 years for women, children, or individuals who have completed the age of 65.

This will increase from 2 to 4 years for individuals who have completed the age of 70, and from 4 to 5 years for individuals who have completed the age of 75.

For individuals who have completed the age of 80, it will be possible to decide on the execution of a prison sentence of up to 6 years at home.

With the law, the lower limit of the prison sentence to be given for the crime of intentional injury is increased from one year to one and a half years.

The lower limit of the prison sentence to be applied to those who drive under the influence of alcohol or drugs is increased from 3 months to 6 months.

Those who receive a prison sentence of less than two years will definitely enter prison.

This sentence will be at least 5 days.

8 ARTICLES REMOVED

8 articles in the 30-article draft law that were objected to by the opposition were removed from the draft text with motions submitted in the General Assembly.

One of these is the article stipulating a prison sentence of 1 to 5 years for those who fire weapons, including those that can fire sound and gas cartridges, or use explosive materials.

The other is the regulation aimed at giving a prison sentence of one to 3 years to those who block or stop a person's vehicle.

The regulation, which stipulates that the crime of intentionally endangering general safety be included in the scope of qualified offenses when committed in places where people are collectively present, is also among the articles removed from the text.
