First statement from Akın Gürlek following the indefinite alimony ruling

The Constitutional Court has annulled, by majority vote, the regulation providing for the payment of indefinite alimony after divorce. Following the decision, Minister of Justice Akın Gürlek announced that a new legal regulation would be submitted to the discretion of the Grand National Assembly of Turkey (TBMM).

The Constitutional Court (AYM) has annulled the provision regulating the payment of indefinite alimony after divorce. The decision was evaluated by the General Assembly of the Constitutional Court upon the application of the Antalya 12th Family Court.

The General Assembly, which examined the regulation in Article 175 of the Turkish Civil Code No. 4721 that allows for poverty alimony to be granted indefinitely, decided to annul the provision by majority vote. The court granted the TBMM a 9-month period to enact a new legal regulation.

STATEMENT FROM MINISTER GÜRLEK

Following the decision, Minister of Justice Akın Gürlek made evaluations on his social media account.

Gürlek used the following expressions in his statement:

"The construction of a balanced and fair model that will both protect the rights of the parties in post-divorce processes and not damage social peace or the dignity of the family institution was one of our priority agenda items.

In line with the intense demands from our citizens and practices in the field, this issue already constituted one of the most fundamental topics of the Judicial Package, to which we have been meticulously contributing in our preparations.

In this framework, we find the annulment decision given by the Constitutional Court regarding the 'indefinite alimony' regulation in the Turkish Civil Code to be extremely valuable in the name of the principles of justice and equity.

Taking into account the legal process granted by the Constitutional Court, we will submit a new legal regulation that is in accordance with equity and does not victimize one party under an unfair lifelong obligation to the discretion of our supreme Parliament.

Under the leadership of our President, Mr. Recep Tayyip Erdoğan, we will continue our reform steps with determination to make the Century of Turkey the century of justice and social peace."
