Aziz İhsan Aktaş, who was a defendant in the Beşiktaş Municipality indictment and whose testimony after becoming a whistleblower led to the arrest of numerous CHP mayors, has applied to the Istanbul Çağlayan Courthouse to request the removal of the injunctions on his seized assets. In addition to his appeal to the 2nd High Criminal Court, Aktaş also submitted a five-page petition to the 1st High Criminal Court, where the Beşiktaş Municipality case is being heard.

According to the report by Özgür Cebe from Sözcü, In his petition, Aktaş requested the removal of all injunctions on his assets to prevent irreparable harm. He also demanded the cancellation of the seizure and trustee appointment decisions regarding Elif LPG ve Akaryakıt Dağıtım Sanayi Ticaret A.Ş.

CLAIM OF VIOLATION OF THE PRESUMPTION OF INNOCENCE

Aktaş stated that his assets were seized at the time of his detention and that the Savings Deposit Insurance Fund (TMSF) appointed trustees to 16 companies based on MASAK reports. In his petition, he argued that treating the allegation of bid-rigging as a predicate offense and seizing assets under the assumption that a crime had been committed before the trial began violates the presumption of innocence.

Emphasizing that "strong suspicion of a crime" is required for the appointment of a trustee, Aktaş stated that the evidence has been collected and there is no possibility of evidence tampering, yet he has been stripped of his authority to manage his assets as the company owner.

10-MONTH PROCESS AND CONCORDAT STATUS

Aktaş stated that the company is in the process of a concordat and, therefore, there is no authority to conduct transactions without the approval of the concordat commissioners. He reminded the court that the trustee decision has caused irreparable damage and that the crime of bid-rigging is not among the catalog crimes. He emphasized that the precautionary measure could be applied for a maximum of five months, but 10 months have passed since the seizure.

STATEMENTS OF SECRET WITNESSES ARE MISSING

Details regarding the Istanbul Metropolitan Municipality (İBB) indictment continue to emerge. CHP Aydın Deputy Bülent Tezcan announced that the statements of 5 out of 15 secret witnesses are not included in the indictment. Tezcan stated that the secret witnesses whose statements are missing are Meşe, Kartal, Şahin, Ladin, and Maun. Furthermore, he remarked, "One of the suspects said, 'The accusations made against me by secret witness Kartal are lies, they are not true.' In other words, they have done something based on secret witness Kartal, but it is not in the indictment."
