Former IYI Party member Mehmet Başaran revealed to be the father of the baby he denied

In Antalya, the court has issued its verdict in the paternity suit against businessman Mehmet Başaran, the former IYI Party Antalya Provincial Chair. In its reasoned decision, the court stated that according to the DNA test results, Mehmet Başaran is the father of the infant D.M.Ş.

A woman named E.Ş. had applied to the gendarmerie on December 11, 2022, claiming that she was 4 months pregnant and that Mehmet Başaran had pressured her to terminate the pregnancy.

In her statement to the gendarmerie, E.Ş. stated that she had been in a relationship with Başaran for approximately 3 years, claimed she was 4 months pregnant, and alleged that she had been threatened.

Following this, Başaran claimed the incident was a conspiracy, filed a complaint against an IYI Party municipal council member and E.Ş., and initiated a lawsuit at the 31st Criminal Court of First Instance.

"I DO NOT ACCEPT ANY OF THE ACCUSATIONS"

Following the news that caused a stir on social media, Başaran also made a statement and denied the accusations. In his written statement, Başaran said, “While I am facing an ugly smear campaign, I do not accept any of the accusations leveled against me. I have consented to any test that may be performed, as I am confident that I will be cleared and that this process will end quickly. I hereby announce that I have resigned from my position as IYI Party Provincial Chair so that politics does not enter the realm of the judiciary and the judiciary does not enter the realm of politics, and because the case will proceed since I am also a complainant as a suspect following the other party's complaint, and to ensure the integrity of the investigation and to prevent harm to the political party I am a member of.”

Despite making the statement, Mehmet Başaran, who remained in a difficult position, had said, “It is an unchangeable fact that I will always be a soldier of the IYI Party. I will continue my active political life once I am cleared as a result of these investigations.

My wish from the independent Turkish judiciary during this process is for this investigation to be concluded with maximum speed,” he had said. Başaran had also been a parliamentary candidate nominee.

BLACKMAIL CASE ENDED IN MARCH

Mehmet Başaran, whose 'illicit affair' was revealed through the application made by his lover named E.Ş., had filed a lawsuit pointing to the then-IYI Party Muratpaşa Municipal Council Member Kamil Korkmaz and E.Ş., who collaborated with him, as the source of the incident he called a 'conspiracy-character assassination'. The 'blackmail' case opened at the Antalya 31st Criminal Court of First Instance ended on March 11, 2024. At the end of the case, where it was proven that Başaran's claims were baseless, an acquittal decision was given for Kamil Korkmaz and E.Ş.

FORENSIC MEDICINE: 'FATHER IS MEHMET BAŞARAN'

Businessman and politician Mehmet Başaran, who denied his illicit affair and the baby girl he had with E.Ş., with whom he lived, experienced a second shock after the 'blackmail' case he lost, this time with a Forensic Medicine Report. As a result of the DNA examinations conducted at the Antalya Forensic Medicine Institute, the samples taken from Başaran and the baby D.M.Ş. were found to be a perfect match. According to the report prepared on April 3, 2024, it was stated that Mehmet Başaran could be the father of D.M.Ş. with a "99.99 percent probability".

COURT ANNOUNCED ITS DECISION

In its reasoned decision, the court stated that according to the DNA test result, Mehmet Başaran is the father of the infant D.M.Ş.

The following statements were included in the court's two-page reasoned decision:

“At the end of the public hearing of the Paternity (Paternity Suit) case pending in our court, in the petition submitted to our court by the plaintiff's attorney, it was requested and filed in summary; that the case be accepted, that it be determined that the infant D.M.Ş. is the child of the defendant, that a legal kinship be established between the infant and the defendant, and that the litigation costs and attorney's fees be left to the defendant.

A letter was written to the Izmir Forensic Medicine Institute for a report to be prepared regarding whether the infant's biological father is the defendant Mehmet Başaran by extracting the defendant's DNA profiles. In the forensic medicine report of the Izmir Forensic Medicine Institute, it was reported in summary; that a comparison was made between the DNA profile belonging to the infant D.M.Ş. and the DNA profiles belonging to the mother E.Ş. and the defendant Mehmet Başaran, and according to the results obtained, it was determined that the person named Mehmet Başaran could be the biological father of D.M.Ş. with a 99.99 percent probability. The case is a paternity suit, and since it was determined in the ATK (Forensic Medicine Institute) report obtained that the defendant is the father of the child subject to the case, and since the report was prepared based on medical data and is suitable for review, and since obtaining a new report would not add anything new to the file, it was decided to accept the case as it was proven in line with the existing ATK report. With the acceptance of the plaintiff's case, it is ruled that it be determined that the defendant Mehmet Başaran is the father of the child D.M.Ş. subject to the case, that a legal kinship be established between them, and that the judgment be notified to the relevant population directorate.”

Ekin Özmen, the lawyer for the infant D.M.Ş., who was proven to be the biological daughter of Mehmet Başaran by the DNA report, stated that the case was opened in 2023 and that no 'Legal Kinship' had been established between the child and Mehmet Başaran before, saying, "Previously, no legal kinship had been established between Mr. Mehmet and the child.

For this reason, the child was a victim. She continued to use her mother's surname. Due to the conflict of interest between the child and the mother, a representative trustee had to be appointed first. We made an application regarding this. After this application was approved, we filed our paternity suit. The process ended about 2 months ago. Our reasoned decision was issued. It was served to us. As a result of the DNA report, it has been finalized that the father is Mehmet Başaran," she said.

"WE HAVE PROVEN OUR CLAIM"

Emphasizing that the file could go to the appellate and Supreme Court stages and that it has not yet been finalized, Özmen said, "It was decided to establish a legal kinship between the father and the child in the DNA report obtained from the official institution. From this point on, our claim has been the same from the beginning. We had a claim that the father was Mehmet Başaran, and we have proven it. After it was decided to obtain a DNA report from an official institution during the hearing, a DNA report was also obtained from a private institution. Despite this, the father did not take any financial or moral responsibility in any way.

There was a refusal on this matter, for this reason, our legal struggle will continue. I hope that after the decision is finalized, a legal kinship will be established between the child and the father. The decision will be finalized after the appellate and Supreme Court process. The child will take Mehmet Başaran's surname, and will also be able to benefit from inheritance rights, custody rights, and alimony rights. We fought our legal battle and won. We are happy for the child and for the process," she expressed.

On the other hand, when reached by phone, former IYI Party Antalya Provincial Chair businessman Mehmet Başaran said that he stands behind his previous statements and that the process proceeded in this way due to the political conspiracy set up against him.
