Clarifying the closed doors, the court stated, "Considering Nevzat's statement that 'when I arrived at the house, all the doors were closed,' it is understood that the defendant Enes was inside the house during the specified time frame and, in consensus with the other defendants, remained silent in the house, waiting for Nevzat to take Narin's lifeless body."

"Salim, together with the other defendants Yüksel and Enes, participated in the act of killing the victim Narin and killed her. Afterward, defendant Salim, along with the other defendants, decided what to do after the killing. During this time, Salim asked defendant Nevzat, who was close to the scene and with whom he was speaking on the phone, to take Narin's lifeless body and dispose of it. This matter was decided together with the other defendants while they were at the home of father Arif Güran, standing over the victim Narin's lifeless body."

FAMILY MEMBERS ACTED IN COOPERATION

The reasoned decision also included the following statements: Given that only Salim was in the house when the victim Narin's lifeless body was handed over to defendant Nevzat and that the other doors were closed, it is accepted by our Court that the defendants Yüksel and Enes, who were in the house, agreed on this matter with defendant Salim and waited behind closed doors; that the narrative told to defendant Nevzat by defendant Salim—that he killed the victim Narin because he saw her in a relationship with Yüksel—was also decided upon together by the other defendants in order to conceal the true motive of the killing, and that they attempted to hide the true motive in this way; that defendant Nevzat stated he saw defendant Yüksel and that she was crying while he was taking the victim Narin's lifeless body and leaving the scene, therefore the other defendants were aware of the incident while Narin's lifeless body was being handed over to defendant Nevzat by defendant Salim; that all 3 defendants, through the roles they assumed in the commission of the crime and by completing their own actions with the actions of the other defendants, established joint control over the commission of the crime together with the other defendants; in this context, it is accepted by our Court that the defendants were in unity of time and place until the end of the incident and, acting in complicity, defendants Salim Güran, Enes Güran, and Yüksel Güran caused the death of the victim Narin Güran in unity of thought and action.
