He had insulted Ekrem İmamoğlu: Prosecutor's office closes ROK file
In the investigation launched following a CİMER complaint regarding the words "you are doing all kinds of dishonorable things" uttered by Rasim Ozan Kütahyalı about Ekrem İmamoğlu before the local elections, the Büyükçekmece Chief Public Prosecutor's Office ruled that there was no ground for prosecution. The Büyükçekmece Chief Public Prosecutor's Office has decided that there are no grounds for prosecution regarding the remarks made by TV commentator Rasim Ozan Kütahyalı toward Istanbul Metropolitan Municipality Mayor Ekrem İmamoğlu, in which he said, "I am saying this at the risk of taking a risk, you are doing all kinds of dishonorable things."
According to T24's report, the Chief Public Prosecutor's Office stated that Kütahyalı's words were not spoken in relation to İmamoğlu's public duty, and therefore constituted the crime of insult, which is subject to reconciliation and complaint. The prosecutor's office also cited the fact that İmamoğlu did not file a complaint as the reason for its decision.
The expressions used by TV commentator Rasim Ozan Kütahyalı regarding Istanbul Metropolitan Municipality (İBB) Mayor Ekrem İmamoğlu before the local elections held on March 31, 2024, had created an agenda.
Making evaluations regarding the local elections to be held on March 31 on Lider Haber, Kütahyalı had put forward striking allegations about İmamoğlu. Kütahyalı had said the following:
"Ekrem İmamoğlu, you see the change in the Kurds. You see that you cannot win by stepping on the backs of the Kurds. I am saying this at the risk of taking a risk, you are doing all kinds of dishonorable things. Buying people, favoritism, distributing money to this and that. Just to be able to ride on the backs of the Kurds again. Look, I tweeted today, this is not like bribing CHP delegates. You bribed CHP delegates, the state is not interfering, I know that you know, I read your report. I read the report of the relevant state institution on how you distributed bribes to CHP delegates, I said it the day I read it. I am not afraid of the state, I will go and explain it. If you hire people and use people, even if you win, it will remain in your hands!"
Following Kütahyalı's words, a citizen filed a complaint via CİMER on March 28, 2024. In the complaint, it was stated that Kütahyalı used insulting expressions about İmamoğlu, and it was requested that the necessary actions be taken against him. Following the complaint, the Büyükçekmece Chief Public Prosecutor's Office launched an investigation for the crime of insult.
The Büyükçekmece Chief Public Prosecutor's Office decided on May 15 that there were no grounds for prosecution. The prosecutor's office stated that Kütahyalı's words were not spoken due to İmamoğlu's public duty, and therefore Kütahyalı's expressions did not constitute the crime of insulting a public official due to their duty, but rather the crime of insult, which is subject to reconciliation and complaint. The prosecutor's office also stated that İmamoğlu had not filed a criminal complaint and that there was an absence of a complaint.
