New development regarding the extradition of Eylem Tok and her son to Turkey: Did the US court postpone the decision? 'For 28 days...'

A critical decision has been made regarding the extradition to Turkey of Timur Cihantimur, who caused the death of Oğuz Murat Aci by driving without a license in Istanbul, and his mother Eylem Tok, who helped him flee abroad.

The extradition of the mother and son, who were captured and arrested in the US, had previously been approved; however, the court ruled that the extradition process should not be carried out until the appeal process is completed.

TEMPORARY OBSTACLE TO EXTRADITION

The US court hearing the case had found the extradition of Timur Cihantimur and Eylem Tok to Turkey appropriate on February 11. Under the Extradition Treaty between Turkey and the US, the court had decided to hand over the two defendants to Turkey.

However, Eylem Tok's attorney, Jennifer M. Herrmann, who objected to this decision, applied to the court to stop her client's extradition.

Following this development, prosecutor Kristen Kearney, who is handling the case, explained the US government's stance on the process in a petition submitted to the court. According to Kearney's statements, the US Department of State will not issue an immediate extradition order despite the court's approval, and the extradition process will be suspended for at least 28 days.

LEGAL APPEAL PROCESS CONTINUES

The prosecution's petition stated that Eylem Tok and Timur Cihantimur have a 28-day period to exercise their right to appeal against the court's decision.

It was stated that if a Habeas Corpus petition is filed within this period, the extradition process cannot proceed until the court reviews this application.

If the court does not accept the appeal, the US Department of State may issue an order for the handover of Tok and Cihantimur to Turkey. However, how this process will unfold will be shaped by new applications and additional decisions to be made by the court.

JUDGE'S DECISION: 28-DAY POSTPONEMENT

The court evaluated the petition submitted by the US Prosecution and decided to temporarily halt the process. Judge Donald L. Cabell included the following statements in his electronically published decision:

"The court will sign the certification and commitment document regarding the extradition of Eylem Tok submitted by the US government and forward it to the Department of State. However, the US Department of State will not hand over Tok to Turkey for 28 days from the date this document is recorded. In the event that Tok files a Habeas Corpus petition within this period, the US administration will not advance the extradition process until the court evaluates this application."

This decision means that the extradition process to Turkey is suspended for at least 28 days. If Tok and Cihantimur submit new appeal petitions to the court during this period, the extradition process could be further delayed. The final decision to be made by the court will be finalized with the approval of the US Department of State.
