New regulation coming for alimony: An upper limit will be introduced

The Ministry of Justice is working on a new legal regulation regarding unpaid alimony. The prepared draft foresees significant changes regarding the disciplinary imprisonment applied to individuals who do not pay their alimony debts.

NEW REGULATION PREPARED

According to the information obtained, the procedures regarding the imprisonment of individuals who do not pay alimony debts will be redefined in the new penal regulation draft prepared by the Ministry of Justice. In the draft, the debtor will not be punished a second time for being unable to pay alimony while in prison.

In this context, a provision will be introduced stating that the total disciplinary imprisonment given due to alimony debt cannot exceed one year. Thus, it is aimed to prevent repetitive imprisonment practices for the same debt.

UPPER LIMIT COMING TO DISCIPLINARY IMPRISONMENT

According to the news in the Türkiye newspaper, it is planned to introduce an upper limit to the disciplinary imprisonment applied to individuals who do not pay alimony debt in the draft text. With the new regulation, it will be ensured that fixed-term prison sentences do not exceed a certain limit if the non-payment situation continues.

In addition, the rule that the prison sentence ends upon payment of the debt will be preserved.

JUDICIAL PACKAGE TO COME TO PARLIAMENT

The regulation, for which preparations have been completed, is expected to be submitted to the Grand National Assembly of Turkey shortly. It was reported that the changes regarding alimony imprisonment will be included in the new judicial package.

It was stated that in addition to the alimony regulation, the judicial package will also include some other changes regarding enforcement and criminal law.

If the new regulation is enacted, the implementation principles of prison sentences given due to alimony debt will be completely renewed.
