Prosecutor's opinion announced in the trial for the Isias Hotel, which became a tomb for 72 people

The 5th hearing of the Grand Isias Hotel trial in Adıyaman, where a total of 72 people, including 39 TRNC volleyball players, teachers, and coaches, lost their lives in the Kahramanmaraş-centered earthquakes, began in the morning at the Adıyaman Courthouse.
The defendants in custody, hotel owner Ahmet Bozkurt, his son and board member Mehmet Fatih Bozkurt, and architect Erdem Yıldız, attended the hearing via SEGBİS, where 11 people, 3 of whom are in custody, are being tried in the 3rd High Criminal Court for the crime of "causing the death and injury of more than one person with conscious negligence."
PROSECUTOR'S OPINION ANNOUNCED IN THE 5TH HEARING
In the hearing, the public prosecutor requested that all defendants be sentenced separately to 22 years and 6 months in prison for the crime of "causing the death and injury of more than one person with conscious negligence."
In the opinion announced by the Chief Public Prosecutor's Office, it was stated that Ahmet Bozkurt was at fault due to his position as the chairman of the board and building owner, citing the number of floors, floor height, non-compliance with standards, failure to properly construct stirrups, deficiencies in the building's load-bearing system, manufacturing and inspection errors, and failure to execute the project as required. It was also noted that his children Mehmet Fatih Bozkurt, Efe Bozkurt, Bilge Açık, Şule Özbek, Seda Zeren, and his wife Ulviye Bozkurt, as board members and building owners, were at fault for failing to have a static and reinforced concrete project prepared for the elevator shaft opening and for adding an illegal floor to the building without obtaining a building permit.
At the same time, it was stated that the technical supervisor, Civil Engineer Hasan Aslan, was at fault for using defective materials that did not meet standards and failing to carry out necessary procedures; that the detained defendant, technical supervisor architect Erdem Yıldız, was at fault for providing a report on the building's structural integrity despite it being outside his area of expertise and for obtaining a building permit without preparing a comprehensive static and reinforced concrete project; that technical supervisor civil engineer Halil Bağcı was at fault for preparing a structural integrity report based only on the basement floors despite deficiencies in column reinforcement without conducting necessary inspections; and that Civil Engineer Mehmet Göncüoğlu, who was the project author for the obtained permits, was at fault because the hotel exceeded 21 meters and the curtain walls added to the building were insufficient.
On the other hand, the prosecutor requested that each of the defendants be sentenced separately in accordance with Articles 85/2 and 22/3 of the Turkish Penal Code, taking into account the number of deceased and injured and moving away from the lower limit; that the detention of the defendants currently in custody continue; that the judicial control measures for the other defendants continue; and that defendants Hasan Aslan, Halil Bağcı, Erdem Yıldız, and Mehmet Göncüoğlu be banned from practicing their professions under Article 53/6 of the Turkish Penal Code for acting contrary to the obligations required by their professions.
