Following these remarks, while the question 'Can a trustee be appointed to political parties?' has come to the fore in political and legal circles, experts on the subject have evaluated this possibility.
“NOT A TRUSTEE, ONLY A CALL COMMITTEE CAN BE APPOINTED”
Former Minister of Justice Prof. Dr. Hikmet Sami Türk explained that under current laws, it is not legally possible to appoint a trustee to political parties. Türk stated, 'The judiciary can only appoint a call committee. The duty of this committee is limited to taking the party to an ordinary or extraordinary congress. It is not a matter of taking over the management of the party,' he said.
Türk also recalled that Law No. 2325, which allowed for the appointment of trustees to political parties in the past, was abolished after the September 12 period, implying that Kılıçdaroğlu's concerns lack a legal basis.
Former Court of Cassation Judge Ömer Faruk Eminağaoğlu also pointed to an important point regarding the case. Eminağaoğlu stated, 'Kılıçdaroğlu is not a plaintiff in this case. Therefore, even if a decision of absolute nullity were to emerge, the current administration cannot return without a court order.'
Eminağaoğlu also emphasized that the court's decision would not be implemented immediately and would first have to go through the appellate and supreme court stages, stating that the execution would only be effective once the decision becomes final.
“LEGAL CHAOS MAY BE AT THE DOOR”
Former Public Prosecutor Bülent Yücetürk warned that the process could create not only legal but also political chaos. Yücetürk stated, 'If the court cancels the convention, this decision cannot be implemented immediately. If the appellate court decides otherwise, great confusion could be experienced both within the CHP and in public opinion.'
CHP PROVINCIAL CHAIRS GATHER IN ANKARA
Political traffic has also accelerated on the CHP front ahead of the June 30 hearing. It has been learned that the CHP's 81 provincial chairs will gather in Ankara to express their open support for the convention process and the current party administration. A joint statement is expected following the meeting.
