Yılmaz Tunç lists crimes for which penalties will be increased

Minister of Justice Yılmaz Tunç answered questions from journalist Sinan Burhan on the program "Eşit Ağırlık" (Equal Weight) with Erdoğan Aktaş, broadcast on tv100. Providing important information regarding the major changes to be made to the Penal Execution Law, Minister Tunç announced that penalties will be increased for many crimes frequently encountered in society.

TOUGHER SANCTIONS COMING FOR VIOLENCE AND THREATS

According to Tunç's statements, penalties for crimes such as intentional injury, injury resulting in severe consequences, and threats will be increased. In particular, the legal regulation regarding the crime of firing a weapon in residential areas will be expanded. Firing blank-firing guns will now also be evaluated within this scope and will be punishable by 1 to 5 years in prison. If this act occurs at mass events such as weddings, engagements, or military send-offs, the penalty may be increased by half up to double.

HEAVY PENALTIES FOR THOSE DRIVING UNDER THE INFLUENCE OF ALCOHOL AND DRUGS

Under the new regulations, those who get behind the wheel under the influence of alcohol or drugs will now face heavier sanctions. The penalty foreseen for these individuals will be increased from 6 months to 2 years. Additionally, the act of blocking traffic will be defined as an independent crime, and perpetrators will be tried with a prison sentence of 1 to 3 years.

NEW REGULATION FOR ORGANIZED CRIMES

Following the Constitutional Court's annulment decision, the regulation concerning individuals who commit crimes on behalf of an organization but are not members of the organization is being reshaped. Furthermore, increasing the penalties for the crimes of establishing, managing, and being a member of an organization is on the agenda.

For intentional crimes, the lower limit of the sentence will be increased from 1 year and 6 months to 3 years; for crimes committed by negligence (excluding causing death by negligence), it will be increased from 3 years to 5 years.

SCOPE OF HOME-BASED PENAL EXECUTION IS BEING EXPANDED

Home-based penal execution periods for certain special circumstances are also being expanded. According to the new regulation;

The home execution period for women, children, and individuals over 65 can be extended from 1 year to 3 years,

For individuals over 70, from 2 years to 4 years,

And for those over 75, from 4 years to 5 years.

For those over 80, this period can reach up to 6 years.

Additionally, for those who cannot enter prison due to health conditions or disability, sentences of up to 5 years can be executed at home. There are plans to increase this period to 10 years. For sentences given due to childbirth, the home execution period will be increased from 3 years to 5 years.
