In June 2023, the sentence for the 19-year-old driver who caused the death of 5 people and the injury of 20 others while weaving through traffic with his light commercial vehicle in İzmir has been determined.

The defendant, Y.İ.K., who is in custody, attended the hearing at the 7th High Criminal Court via SEGBİS, while the lawyers for the parties and the complainants were present in the courtroom.

The presiding judge stated that the traffic report obtained from the Council of Forensic Medicine had reached the court. The driver was sentenced to 18 years in prison.

HE DEMANDED ACQUITTAL

The defendant's lawyers claimed that there were deficiencies in the report and requested that the report be renewed and that it be determined whether he had signaled before overtaking.

The public prosecutor, presenting his opinion on the merits, requested that the defendant be punished for the crime of "causing the death and injury of more than one person through conscious negligence" and that the sentence be set above the lower limit.

The defendant's lawyer stated that the defendant was 18 years old at the time of the incident and that he had turned himself in after the accident, saying, "There was no weaving through traffic as alleged. He is young and has had his driver's license for 1 year. He himself admits that he is heavily at fault. We request that he be punished for simple negligence and that the sentence be set at the lower limit."

In his final defense, the defendant requested his acquittal. The presiding judge sentenced the defendant to 12 years in prison for the crime of "causing the death and injury of more than one person through negligence," and ruled that the sentence be increased by half to 18 years because the crime was committed with "conscious negligence." Furthermore, no discretionary reduction was applied to the defendant.
