In the indictment prepared as part of the investigation into the sexual abuse of a minor girl in Istanbul and accepted by the Anatolian 2nd High Criminal Court, it was requested that the defendant Kadir İstekli be sentenced to no less than 30 years for the crimes of "qualified sexual assault" and "qualified sexual abuse of a child," and that Yusuf Ziya Gümüşel and Fatıma Gümüşel be sentenced to no less than 18 years for "complicity in the qualified sexual abuse of a child."
HEALTH CONDITION CITED AS REASON
According to the report by journalist Ceylan Sever, Yusuf Ziya Gümüşel, who was sentenced to 18 years and 9 months in prison, was released with judicial control measures applied in the form of house arrest and a travel ban due to health problems.
Gümüşel and his lawyer appealed his detention, citing his health condition.
Evaluating the application, the 20th Criminal Chamber of the Istanbul Regional Court of Justice stated, "When the defendant's health reports submitted to the file, the fact that an application has been made to the Council of Forensic Medicine for the same reason, and the entire content of the documents are evaluated together, it is assessed that while the grounds for detention continue to exist, considering his health condition according to the reports, it would be sufficient to place him under judicial control instead of keeping him in detention in this state."
The court decided to release Gümüşel under judicial control conditions of house arrest and a travel ban. The decision also stated that the right to appeal against the ruling remains open.
