The Ministry of Justice, following a criminal complaint filed regarding attorney Alperen Demirdiş, who requested the recusal of the judge during a hearing at the Ankara 1st High Criminal Court because the presiding judge and the member judge were wearing headscarves, granted permission for an investigation and sent the file to the Ankara Chief Public Prosecutor's Office.
WHAT HAD HAPPENED?
Defendants Ufuk A. and Serdar B. appeared before the judge in a case at the Ankara 1st High Criminal Court where they were being tried for 'drug trafficking.'
Defendant Serdar B.'s attorney, Alperen Demirdiş, requested the recusal of the judge. Attorney Alperen Demirdiş stated, "The Republic of Turkey is a secular state governed by the rule of law. The independence of the court is guaranteed by the Constitution. I am requesting the recusal of the presiding judge and the member judge who are performing their duties with religious symbols."
The presiding judge decided to grant the defendant's counsel 3 days to submit the recusal request in writing, to rule on the request once the grounds for recusal were submitted, and furthermore, since a recusal request had been made for the presiding judge and the member judge of the court panel, not to take any further action until this process was concluded.
It was learned that the court panel, which adjourned the hearing to July 2, filed a complaint with the Ankara Bar Association No. 1 regarding the attorney's statement.
