The court has announced its verdict in the ongoing trial regarding the death of Elif Ceren Arslan, who was murdered on September 10, 2024, in the Selçuklu district of Konya by a man she had rejected.

The Konya 2nd High Criminal Court sentenced the defendant Emrah Demirkan, who was being tried while in custody, to aggravated life imprisonment for the “intentional killing of a woman, based on the manner in which the crime was committed, the tool used in the commission of the crime, the importance and value of the subject of the crime, the severity of the damage caused, the severity of the defendant's intent-based fault, and the purpose and motive pursued by the defendant.”

HE REQUESTED AN UNJUST PROVOCATION REDUCTION!

The request for an unjust provocation reduction by Demirkan, who murdered Arslan, was also rejected by the court. In his statements, Emrah Demirkan requested an unjust provocation reduction from the court by recalling past arguments between him and Elif Ceren Arslan. However, he also stated that he had gone to the massage parlor where Arslan worked on the day of the incident “with the intention of reconciling.”

In the verdict, the request was rejected with the statement: “Since it was concluded that the defendant did not commit the act under unjust provocation, there is no room for the application of unjust provocation provisions in accordance with Article 29 of the Turkish Penal Code (TCK), and considering the defendant's behavior after the act and the possible effects of the sentence on his future, there is no room for a discretionary reduction in accordance with Article 62 of the TCK.”

‘IT WAS A VALUABLE CASE’

Arzu Sena Topuz, a lawyer for the Children and Women First Association who has been involved in the case from the beginning, stated: “The defendant says he went to the massage parlor on the day of the incident ‘to reconcile.’ Someone who says ‘I went to reconcile’ cannot benefit from an unjust provocation reduction by claiming to have experienced certain grievances in the past. Because if he wants to reconcile, the claims he could present as elements of provocation also disappear. In other words, there is no element of provocation left. Even though the other side requested an unjust provocation reduction despite this, we emphasized in both hearings that this was not possible. Ultimately, this was reflected in the court's decision. This case was a valuable case for the Children and Women First Association.”

WHAT HAPPENED?

Elif Ceren Arslan was murdered by being stabbed by Emrah Demirkan, a man she had rejected, who came to the massage parlor where she worked in the Selçuklu district of Konya. It was revealed that there was severe incompatibility between them, that Arslan had moved out of the house they lived in and started living at the massage parlor where she worked, and that Emrah Demirkan had previously assaulted Elif Ceren Arslan and had a restraining order against him. Demirkan, who had previously threatened to kill her many times, murdered Elif Ceren Arslan on September 10, 2024, at the massage parlor where he said he “went to reconcile.”
