Husband who spat in mother-in-law's face deemed heavily at fault

The 2nd Civil Chamber of the Court of Cassation has issued a precedent-setting decision in divorce cases.

In a divorce case heard in Ankara, the court of first instance ruled for divorce, noting that while both spouses had engaged in various forms of misconduct, the defendant husband had also consistently subjected his wife to physical violence, was aggressive and abusive, and had humiliated his wife's mother by spitting in her face.

The lawyers for the parties appealed certain decisions made in the case and applied to the Regional Court of Justice (BAM) for appellate review. After the appellate requests were examined and rejected, the case was then taken to the Court of Cassation.

Following the appeal review, the 2nd Civil Chamber of the Court of Cassation also rejected the parties' objections in this regard, ruling that humiliating his wife's mother by spitting in her face was a culpable act.
The Court of Cassation's decision included the following statements:

"In the events that caused the marital union to be shaken to its foundations, the defendant husband is heavily at fault. The culpable behaviors that occurred also constitute an attack on the woman's personal rights. As such, it is not correct to consider the parties equally at fault and, based on this erroneous determination of fault, to reject the plaintiff woman's claims for pecuniary and non-pecuniary damages."
