IMM filed a lawsuit: Council of State puts a stop to meritless promotions in the fire department

Following a lawsuit filed by the Istanbul Metropolitan Municipality (IMM), the Council of State has issued a stay of execution regarding a regulation that allowed for promotions in the fire department contrary to the principles of merit and career advancement.

Istanbul Metropolitan Municipality filed a lawsuit requesting the stay of execution and cancellation of the Ministry of Environment, Urbanization and Climate Change General Directorate of Local Administrations' May 26, 2023, action to remove applications from the list for the promotion exam opened for fire department personnel, on the grounds that it was not in compliance with the legislation, as well as the phrase "grade" in Article 21 of the 2013 Municipal Fire Brigade Regulation.

According to the report by Sözcü, as a result of the lawsuit, the Council of State 2nd Chamber stayed the execution of the phrase "grade" in the regulation. It found the ministry's decision regarding the promotion exam to be in accordance with the law and rejected the request for a stay of execution.

In the decision, it was stated that the phrase "grade" in the regulation would both lead to application restrictions between grades during the application phase for the promotion exam and would lead to a quota application based on staff positions during the appointment process, which should be based on success scores.
