Important ruling from the Constitutional Court in the Gezi Park case: Path to retrial opened

The Constitutional Court (AYM) has ruled that the right to a fair trial was violated for defendants who were prosecuted and convicted for participating in the Gezi Park protests in Ankara in 2013. This decision has paved the way for a retrial process for the defendants.

Evaluating the application, the AYM determined that the right to a fair trial was violated for the defendants for whom the local court had issued a "deferment of the announcement of the verdict" (HAGB). With this decision by the High Court, the cases of the defendants will be reviewed again, and a retrial process will be initiated to remedy the violations.

According to the report by Cumhuriyet, one of the applicant's lawyers, Doğan Erkan, described the decision as an important development, stating, “This decision by the AYM is the first positive response given to applications regarding the violation of the right to a fair trial, and it is a beginning for the rectification of these violations.”
